11-13-44 Regular 2365 COUNCIL CHAMBER November 13, 1944 , The Council met in regular session at 7:30 P. M. with the City Attorney and all members of the City Council present. Minutes of regular meeting held October 23rd, special meeting held October 25th, and special meeting held November 8th were read by tne Clerk and approved as read. The Mayor called for objections on the paving on N.W. 2nd St. from the Railroad to N.E. 2nd Avenue, at an estimated cost of $1,500. according to plans on file and specifications, also on N.W. 4th Avenue paving assessment. No objections were raised. Attorney representing F.J. Schrader presented Resolution which would revert Crest Lake Park back into acreage. On Attorney Nowlin's recommendation Mr. Wodischek moved that the Resolution be passed on its first reading. Mr. McFee seconded the motion which carried unanimously on roll call. At this time Mr. V. Giardano, who was in the audience, addressed the Council protesting to busses driving over the sidewalk at Bus Station. Mayor Thayer agreed to investigate this matter and take whatever steps are necessary to correct the situation. Councilman Jacobs recommended that the City fill in with rock the area in back of the U.S.O. building, rolling same, for driveway purposes. Mayor Thayer agreed to contact a lifeguard in Miami relative to securing his services for the City Councilman McFee reported Sanitary inspection is going on very well. Councilman Wodischek reported the State Board of Health reported our water as satisfactory. He asked the Council if they would like to go ahead and make repairs to our reserve water tank at this time. Members expressed themselves as not being in favor of undertaking this work at the present time. 2366 November 13, 1944 The City Clerk reported interested parties had been sent copies of resolutions pertaining to out of town water consumers. The Mayor stated he would call a special meeting of the Council to which these persons will be invited to discuss the matter. At this time Councilman McFee asked who had drawn up the specifications for road repairs to N.W. 2nd Street. After considerable discussion, it was brought out that no engineer had been appointed by the Council to do this. Councilman McFee stated that inasmuch as the Charter provmdes that an engineer must be appointed for a lien certificate job, we had best start allover again on this road repair matter. Councilman Wodischek moved that Howard Cromer be appointed as acting City engineer on this work. Mr. McFee seconded the motion and on roll call the vote was as follows: Mr. Jacobs not voting, Mr. McFee yes, Mr. Thayer no, Mr. Waters no, Mr. Wodischek yes. Motion was lost. The Clerk was instructed to notify Mr. E. A ndrews that inasmuch as the matter was handled incor- rectly, the Council would hold a special meeting, and decide at that time just how this work will be proceeded with. Attorney Nowlin advised the Council the City could go ahead and do the work themselves, paying for same, as a street repair job if they so desired. A communication from Mr. Raymond White requesting his two lots, 1 and 2 in block 81 be changed to "B" zone rather than remain in "A" zone as they are now, inasmuch as the balance of the block is "B" zone. This matter was referred to the Zoning Commission. Application for liquor license for Bar at the Seacrest was next presented, together with check for same. The Clerk was instructed to advertise in the local paper as per the usual procedure. A communication from M.B. Garris consulting engineer, re: Sea~ate property was read and ordered filed for future consideration. Letter from J.F. Riley, Jr. regarding Biggs water bill was next read. The Clerk was instructed to inform Mr. Riley our investigation which included sending the meter back to the factory for check-over 2367 November 13, 1944 proved that the water was used at the Biggs residence, and the bill was properly calculated. Gaynon Iron Works' letter relative to sanitary truck was read and ordered filed. A communication from A.B. Laiton pertaining to assessed valuations was read and ordered turned over to Assessor Ogren for reply. Written offer from J.M. Cromer of $350. cash for lot 22, block 1, Del Ida Park, which is owned by the City was read. This matter was turned over to the Finance Committee for investigation and report back at next meeting. Letter from Lionel Cassel requesting right to redeem his city lots after he gets them straightened out as to County taxes was read. The Clerk was instructed to inform him that they can be redeemed before we get a final decree. After we get it, the lots will be sold to the highest bidder. Communication from South Florida Roofing Company explaining the reason this company did not do the work on city hall fire shed according to City specifications was read. The Clerk was then instructed to pay the bill. Councilman McFee moved that the Clerk be instructed to abate $3.46 personal property assessed against C. & G. Plumbing Co. inasmuch as they were not in business on January 1st. Mr. Wodischek seconded the motion which carried unanimously on roll call. The Clerk was instructed to issue occupational license to R. White, also to C. Clem. Letter from Mrs. Bertha Thieme protesting to charge of City taxes on her home which was formerly the Methodist parsonage was read. The Clerk was instructed to write the Church and find out from them if on January lst, 1944, this property was being used by them as a parsonage. The Clerk reported that so far $21,OOO had been collected on the 1944 taxes. The Council approved the Clerk's ordering a new electrical adding machine for her office. 2368 November 13, 1944 Bills #1932 through #1981 having been approved by the Finance Committee amounting to $4,981.21 were by motion regularly made, seconded and carried, ordered paid. Ordinance #517 pertaining to coin operated machines was presented by Attorney Nowlin. The Council agreed to study the ordinance before any action is taken. ORDINANCE NO. 517 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA , PROVIDING FOR LICENSE FOR CERTAIN MACHINES OR DEVIEES FOR WHICH A LICENSE IS AUTHORIZED BY SECTION 205.63 FLORIDA STATUTES 1941, AND PROVIDING FOR THE APPLICATION FOR SUCH A LICENSE, THE AMOUNT THEREOF AND A PENALTY FOR THE USE OR OPERATION OF SUCH MACHINE OR DEVICE WITHOUT SUCH LICENSE BEING OBTAINED. The following Ordinance was by motion regularl~ made, seconded and carried, passed on its first rea ding. ORDINANCE NO. 518. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA , DESIGNATING THE ZONES IN WHICH ALL LOTS IN SEESTEDT-STEVENS SUBDIVISION AND BLOCK 139 WEST OF FLORIDA INTRA - COASTAL CANAL SHALL BE LOCATED, DESIGNATING THE FRONT YARD REQUIRE- MENTS AND SIDE YARD REQUIREMENTS OF CERTAIN LOTS AND REPEALING ALL PORTIONS OF ORDINANCES IN CONFLICT HEREWITH. By motion regularly made, seconded and cErried, Frank Stanley was appointed as City policeman at the same rate of pay as the other policemen are now receiving. 2369 November 13, 1944 Next, the Council discussed the advisability of purchasing an additional police car. Chief of Police Croft was instructed by the Council by motion regularly made, seconded and carried, to proceed with repairing the present car, said repairs to cost $400. At Council- man Jacobs request, Mayor Tnayer agreed to proceed immediately getting together data relative to purchasing another car. Supt. C.C. Turner stated inasmuch as the housing project on S. Swinton is going through, he would advise running a 4" water main through the property rather than the customary 2~line, to insure proper pressure. Councilman Wodischek agreed to contact the government regarding possibility of purchasing some of the used_er p'tpes from Camp Murphy.
