11-20-44 Special 2371 COUNCIL CHAMBER November 20, 1944 , The Council met in Special Session at 8 D'clock P.M. for the purpose of preparing the ballot box for Primary Election, also for any other matters of business which might need the action of the Council at this time, on call of the Mayor. The following members were present: Mr. Jacobs, Mr. McFee, Mr. Thayer, Mr. Wodischek and City Attorney Nowlin. Mr. Waters was absent. Mayor Thayer suggested all other business be transacted before preparing ballot box. The first matter to come up was the offer from Mr. J.M. Cromer to purchase lot 22, block 1, Del Ida Park which the City owns. Mayor Thayer advised that the City has received a higher bid from Mr. Fred B. Scott on this lot. Quite a discussion ensued during which Councilman Jacobs pointed out Mr. Cromer's client wished to use the lot for building purposes and this was more desirable than selling the lot to someone for speculation purposes. Councilman Wodischek moved that the City advertise in the local newspaper one time, that the City Council will receive bids (sealed) Monday night, November 27th. 1944 on lot 22, block 1, D el Ida Park. Minimum price they will consider will be $350.00 Special Warranty Deed will be furnished, but no abstract. The Ciy reserving the right to accept or reject any or all bids submitted. Sealed bids to be opened at 8 P.M. Councilman McFee seconded the motion which carried unanimously on roll call. Next sketch and letter from V.A. Genton pertaining to temporary permit for living quarters to be erected on lot 5, block 92, was presented. After con- siderable discussion, Mr. Wodischek moved that temporary permit be granted V.A . Genton, with the understanding that the building must be removed at any time the CoUncil requests it. Mr. Jacobs seconded the moion, and on roll call the vote was as follows: Mr. Jacobs yes, Mr. McFee not voting, Mr. Tijayer yes, Mr. Wodischek yes. Motion carried. Councilman Wodischek stated that inasmuch as Mr. Chas. Senior has submitted his report on Sharpe's work at the Water Tank, said report being satisfactory, he would like to make a motion that bill amounting to $2,875.00 (contract price) be paid Mr. Sharpe. Mr. McFee seconded the motion which carried unanimously on roll call. 2372 November 20, 1944 , Assessor Ogren who was in the audience informed the Council that he had made a trip to West Palm Beach during the afternoon to confer with George Brockway, engineer regarding Atlantic Avenue. He stated that a deviation of 11 feet occurs in Atlantic Avenue as it is now, and it would be most desirable to secure right-of- way deeds from properties involved in order to make the records as they were intended to be. The Council gave Mr. Ogren permission to proceed immediately in securing necessary right-of-way deeds to correct his condition, by motion regularly made, seconded and carried. Assessor Ogren also requested permission to secure from W.B. Stewart, holder of county tax certificates on 10 acres in Section 8, his interest for the city on the portion of this land which City would like to use for possible park site. Councilman McFee moved that Mr. Ogran be given permission to make a deal with Stewart for the purchase of this land, reimbursing him for the money he paid the county, plus a small cash payment of around $25.00. Mr. Wodischek seconded the motion which carried unanimously on roll call. Mr. Ogren requested the Council take some steps to assist the colored citizens in keeping down delinquency amoung the younger children. He stated transient workers were allowing their young children to roam .he streets until late at night, and he older colored residents were very anxious to have a curfew law estab- lished for colored town. After discussing the matter, the Council asked the Mayor to contact these people, and have them appoint a citizens' committee, with whom the Police Dept. and the Council will be glad to cooperate. A pplication by Jesse Nelson for dry cleaning and laundry occupational license was next considered. Assistant Police Chief Grantham agreed to investigate Nelson, reporting to the Mayor, who in turn will notify the Clerk if it is okeh to issue license, by motion regularly made, seconded and carried. Wire from Daytona Beach Chamber of Commerce re: Intracoastal Waterway widening was read. Mayor Thayer by motion regularly made, seconded and carried, was instructed to wire reply to Senate of the U.S. requesting their cooperation in passage of this Bill. Supt. Turner informed the Council that a numb~ of our concrete-wood benches needed repair. Seven of them could be repaired at a cost of $7.50 per bench. He also , 23?:J November 20; 1944 , . recommended the City purchase about ten new benches, at a cost of $15. each. Councilman McFee moved that Supt. Turner be authorized to purchase 15 new benches and that he have necessary repairs made to the ones which needed it. Mr. Wodischek seconded the motion which carried unanimously on roll call. A t this time the Clerk submitted to the Council, list of registered voters, duplicate election return sheets, printed ballots, pencils, absentee voters ballots (13), and other parapheraaalia necessary for the holding of the City's Primary Election, No ember 21st. A fter exam- ination and being declared by the Council in proper order, it was regularly moved, seconded and carried, that these be placed in the ballot box and that the box be locked, sealed, and delivered to the Clerk of the Election Board, with instructions as to the holding of the Primary Election, in compliaace with the Charter of the City of Delray Beach, and the election laws of the State of Florida. Councilman Wodischek moved that the Clerk and Inspectors at the Primary Election be paid $6.00 per day and be given two meals, each. Mf.
