AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 9, "BUILDINGS
AND CONSTRUCTION", ARTICLE VIII, "SIGNS AND BILLBOARDS",
SECTION 9-19g, "DEFINITIONS", OF THE CODE OF ORDINANCES
OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING THE
DEFINITION OF "VEHICULAR SIGN" TO CLARIFY THAT THE
PROHIBITION ON VEHICULAR SIGNS DOES NOT INCLUDE "~RES-
SURE SENSITIVE" TYPE SIGNS, WHICH ARE PERMANENTLY
AFFIXED TO A VEHICLE; PROVIDING A SAVING CLAUSE; PRO-
VIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 9-19g, "Definitions", "Vehicular Sign", of the Code of Ordinances
of the City of Delray Beach, Florida, is hereby amended to read as follows:
Vehicular sign: A sign or sign structure attached or affixed in any manner in
or to any wheeled vehicle for the purpose of advertising that business to which the
sign refers, excluding, however, "pressure sensitive" type signs which are perma-
nently affixed to a vehicle and signs which are painted upon or magnetically
affixed to a vehicle, which is regularly used'as such in the normal course of the
business advertised or which may be required by law, and further excluding such
signs attached or affixed to public transportation vehicles for business advertising
purposes when such vehicles belong to a duly licensed public transportation
company.
Section 2. That should any section or provision of this ordinance or any portion thereof,
any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder hereof as a whole or part thereof other
than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten (10) days after passage on
second and final reading.
