AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING" OF THE CODE OF
ORDINANCES BY DELETING SECTION 30-11 "GC (GENERAL COM-
MERCIAL)~ DISTRICT" (B) "PERMITTED USES" (77) AND SECTION
30-12 "SC (SPECIALIZED COMMERCIAL) DISTRICT" (B) "PERMITTED
USES" (91) RELATIVE TO STORAGE BUILDINGS ACCESSORY TO THE
PRIMARY COMMERCIAL USE AND FURTHER AMENDING SECTION 30-11
"GC (GENERAL COMMERCIAL) DISTRICT" (C) "CONDITIONAL USES"
AND SECTION 30-12 "SC (SPECIALIZED COMMERCIAL) DISTRICT"
(C) "CONDITIONAL USES", TO INCLUDE AS A CONDITIONAL USE
STORAGE BUILDINGS ACCESSORY TO THE PRIMARY COMMERCIAL USE;
PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 30-11 (B) (77) "GC (General Commercial)
District and 'sec~on 30-12 (B) (91) "SC (Specialized Commercial) District"
of the Code of Ordinances of the City of Delray Beach are hereby repealed.
Section 2. That Section 30-11 "GC (General Commercial) District"
(C) "Conditional Uses" of the Code of Ordinances of the City of Delray
Beach, Florida, is hereby amended by adding the following:
Storage buildings for merchandise, when accessory to,
and located on the same parcel of land as the primary
commercial use; and provided that such storage buildings
are not shared or leased independent of the primary
commercial use of the building.
Section 3. That Section 30-12 "SC (Specialized Commercial)
District" (C) "Conditional Uses" of the Code of Ordinances of the City of
Delray Beach, Florida, is hereby amended by adding the following:
Storage buildings for merchandise, when accessory to,
and located on the same parcel of land as the primary
commercial use; and provided that such storage buildings
are not shared or leased independent of the primary
commercial use of the building.
Section 4. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 5. That this ordinance shall become effective ten days
after passage on second and final reading.
