COUNCIL CHAMBER
February 8, 1943
The Council met at 7:30 P.M. with tre City :Attorney and all members
present.
By motion regularly made, seconded and uranimously carried the
mibutes of the last regular meeting held Jll1'luary 25th were approved as read.
Mr. E. C. Mogfo rd appeared at tte meeting expressing appreciation
of home owners in Ocean Breeze Subdivision for the clean-up v,ork recently
done in that part of town by the City Superintendent.
A letter was read from the Lake Warth Drainage DiB trict, soliciting
the City's cooperation in the Legislature passage of a tax cancellation bill,
whereby State ana County taxall for 1942 and 1943 vdll be cancelled on all
lands belonging to the Lake Warth Drainage District, in return for cancell-
ation by the DiB ttiict, of all drainage ilaxes on municipally owned properties
lying wi thing tre drainage district. The letter was ordered filed, and
the Clerk authorized to forward a list of all City of Delray property,
lying within the Drainage District, to W.W. Thomron, Mgr. of the
Drainage District.
The following bid on work needed to be done at the City's Garbage
Dump was received and read:

Wednesday, February lOth, and, if possible, I would like
to dig tre addition to your garbage pit, that is now very

of ditches as I did the last time for a price of $600.00;
this will mean approximately 2,000 cubic yards ofT excavation.

The City Engineer reported that the present ditch would serve for only
a week or two more; that he had contacted four contractors With a view
to obtaining bids for excavating a JEW ditch but had received no
satisfactory replies from any of the m, and since the above bid was

higher than the cost of the previous ditch digging, he would like
instructions from the Council in regard to same. The ChtiTman of the San-
itary Conmittee reported tha t he had inspected the d.1mp and was of th e
opinion tha t th is was the best method of garbage di sposal fo r the
City and therefore moved that the bid of Elton Harvel be accepted and
the work be dore, as ouUlimed. Mr. Wodischek seconded the motion and
on roll call the vote was as follows: Mr. Hill yes, Mr. Jacobs yes, Mr
McFee yes, Mr. Miller yes, Mr. Wodischek yes. The motion was declared
carriea.
Work requisition No. 26, Project 45, covering the removal of
the old 6" terra cot ta stonn sewer and replacing same wi. th new 6" pipe
on N.E. Second Street, between ~I.E. Fifth and Seventh Avenues, was
submitted by City Engineer Croner. An attached letter of explanation
stated that this line was costing approximately $;>00.00 a year to
maintain, which money was a total loss as well as the service from
said sewer being highly unsatisfactoty. The Engineer estimated this
job would cost approximately $580.00 but to secure the car-lot
price of .16 cents for tile it would necessitate an additional
expenditure of $220.00 in order that a minimum car of 2000 feet
might be purchased. He stated the extra 1440 feet of sewer tile
could be stored at tIE water plant for future use.
The condition of the old storm sewer was discussed, it being
stated tha t the sewer was severely overtaxed by the ice-plant's
discharge of water into this line, and that an old agreement with
the ice compll1'lY obligated the City to provide an outlet far this
water disposal from the plant. Mr. Hill trerefore moved that the
City Engineer's reconmendation be carried out. Mr. Wodischek I!leuorlded
the motion and on roll call the vote was as follows: Mr. Hill yes, Mr.
Jacobs yes, Mr. McFee yes, Mr. Miller yes, Mr. Wodischek yes. The
motion carried.
Application of M.C. Naylon for liquor license to operate a bar
at the Patio Delray, under managenent of L. S. Wilson and wife, was
submitted to the Council. It was moved by Mr. Miller that the application
be approved and license issued after tre usual advertising ll1'ld laying-over
of the application for the required fourteen days allowed for objection.
Mr. McFee seconded the motion, and on roll call tIE vote was as follows:

yes. The iIDtion carried.
A petition signed by twenty-six property owners in Block 74
asked that the Council pass an ordinance to control barking and howling
dogs, and the keeping of other animals inside the City limits, that may
become a public nuisance. This matter was by motion of Mr. Miller,
referred to tre City Attorney ~"nd Ordinance Comnittee to bring in an
ordinance or recommendation for regulation of such nuisances. Mr. Hill

Letters were read from J.B. Miller of The State Board of Health,
ad:vising that ths Board's representative had made an investigation of
the lake level at Lake Ida, hut that this matter appeared to be a question
not coming under the jurisdiction of the State Board of Health; also stating
that at the time of their inspection, there was little, if any, mosquito
breeding as a result of the lowering of the lake, but that they were re-
questing the Palm Beach County Engineer, who mndles mosquito control oper-
ations here, to keep close supervision of the lake with respect to any
possible mosquito breeding. The Council discussed the matter further and
recOl1lllended that the Sanitary Committee contact or write a letter to the
Mosquito Control Board, asking that trey install gates to control the water
level of the lake, as one of thsir first projects in 1943.
The City Clerk submitted request of G. Wells forpsrmission to
erect a tent, just East of Williamson's store in colored town, for the
holding of religious meetings by the Seventh Day Adventist Church. It
was moved by Mr. Wodischek that permit be granted on condition that
such meetings .close at 10:00 P.M. and that psrmit may be reMoked if the
meetings prove objectionable. Mr. McFee seconded tre motion and on roll
call the vote was as follows: Mr. Hill yes, Mr. Jacobs yes, Mr. McFee
yes, Mr. Miller yes, Mr. Wodischek yes. The motion carried.
. Upon enquiry, th e Cle rk reported ha ving received no reply from
the F.E.C. Railway Company with reference to a crossing at N.E. First
Street. It was therefore recommended tha t she write direct to P .L.
Gaddis, Supsrintendent, at New Smyrna.
The matter of a dike along Atlant ic Avenue, East of the Canal,
cam!, up for discussion, the Cler k reporting tm t she already had an
agreement from W.C. Williams, dated February 15th, 1936, giving the
City permission to construct such dike and flood-gates. It was there-
fore moved by Mr. Hill tha t the City Engineer be a uthorized to purchase
material and go ahead and construct a dike and instal necessary flood-
gate so that the next high tides will not flood Atlantic Avenue. Mr.
Wodischek seconded the motion and Dn roll call the vote was as follows:

yes. The motion carried.
TIE Clerk submitted a list of registered voters, now deceased,
or who are believed to be no longer residents of Delray, and recommended
tha t their !laIll6lS be stricken from the registration roll; after due adver-
tising, and providing no objection is made thereto. It was moved by
Mr. Miller that the CJsrk's recommendation be approved and said list be
advertised; am after sixty days tha t these names be removed from the
registration roll, where no objection has been made. Mr. Hill seconded
the motion and on roll call the vote was as follows: Mr. Hill ;;e s, Mr.

carried.

It was recomnended by Mr. McFee tha t the Chairman of the Golf
Committee be requested to supply the Courcil with an inventory of the
movable equipment ant at the course, as of February 15th, the date of
its closing.

as he felt it was unnllcessary and would work a hardship on some property

reading. Mr. Wodischek seconded the motion and on roll call the vote

issued by Major General Bryden, governing Atlantic Coastal areas. It
