AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 8, "BOATS
AND BOATING", OF THE CODE OF ORDINANCES OF THE CITY OF
DELRAY BEACH, FLORIDA, BY AMENDING SECTION 8-03,
"DOCKAGE RATES", PROVIDING FOR RATES AND CHARGES FOR
DOCKAGE AT 'THE CITY MARINA; PROVIDING A SAVING
CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 8-03, "Dockage rates", of the Code of Ordinances of the City of
Delray Beach, Florida, is hereby amended to read as follows:
(A) Schedule. The rates for dockage at the city marina shall be in accordance
with the following schedule:
(I) Day-to-day dockage, per foot per day, without regard to whether or
not people may be living on board or not ~ $0.38
(2) Monthly contract of less than four (#) months' duration:
(a) Dock use only, per foot per day ~ 0.2g
(b) If boat will require electrical and/or water service, per foot per
day ~ 0.2g
Monthly contract renewals are subject to one hundred eollars
($100.00) deposits.
(3) Monthly contract of four (~) months duration or longer:
(a) Dock use o~ly, per foot per day ' ~ 0.20
(b) People living on board during dockage, with ll0-volt hookup, per
foot per day ~ 0.23
(c) People living on board during dockage, with 220-volt hookup,
per foot per day ~ 0.2#
A monthly contract of four (g) months' duration or longer ree. uires
first and last months' rental in advance.
(g) Minimum per day. The rates set forth above shall be calculated based on
the actual length of a boat; however, there is hereby established a minimum
charge per day for each category based on an assumed length of thirty-five
(35) feet.
(B) Services Included for Persons Living Aboard. Upon payment of the proper
fees set forth above, persons living aboard while docked in the city marina
will be furnished, at no additional charge, electricity, water, garbage
collection, and shower facilities.
(C) Due Date; Penalty for Delinquency. AU rental fees must be received by the
first of each month. Spaces for which there are rentals unpaid by the tenth
of the month are subiect to being leased at the first of the foUow~ng month.
Section 2. That should any section or provision of this ordinance or any portion thereof,
any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid,
such decision shall not a~fect the validity of the remainder hereof as a whole or part thereof other
than the part declared to be invalid.
Section 3. That this ordinance shall become effective October 1~ 1952.
