61-82 ORDINANCE NO. 61-82 AN ORDINANCE OF THE CITY COUNCIL OF THE C~TY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 9, "BUIhDING5 AND CONSTRUCTION", ARTICLE XII, "FLOOD HAZARDS", OF THE CODE OF ORDINANCE5 OF THE CITY OF DELRAY lEACH, FLORIDA, BY ADOPTING THE FLOOD INSURANCE STUDY FOR THE CITY OF DELRAY BEACH, FLORIDA, DATED MARCH 31, 19B2, AND THE FLOOD INSURANCE RATE MAP, REVISE~D AND EFFECTIVE SEPTEMBER 30, 1982; BY AMENDING SECTIOn1 9-416, "DEFINITIONS", TO DELETE THE DEFINITION OF "HAFITABLE FLOOR" AND TO ADD THE DEFINITIONS OF "FLOOE" AND "COASTAL HIGH HAZARD AREA"; BY AMENDING 5ECTICN 9-421, "BASIS FOR ESTABLISHING AREAS OF SPECIAL HAZAF~D", TO SHOW THE ADOPTION OF THE FLOOD INSURANCE RATE NAP AS REVISED AND EFFECTIVE SEPTEMBER 30, 1982; BY AMENDING SECTION 9-435, "DUTIES OF OFFICIAL", TO ADD NE%V SUB- PARAGRAPH (k) REQUIRING CERTIFICATIONS IN COASTAL HIGH HAZARD AREAS AND A NEW SUBPARAGRAPH (1) TO I~EQUIRE PLANS FOR ADEQUACY OF BREAKAWAY WALLS IN CDASTAL HIGH HAZARD AREAS; BY AMENDING SECTION 9-449, "S?ECIFIC STANDARDS", TO ADD SPECIFIC REQUIREMENTS AND STAN- DARDS FOR COASTAL HIGH HAZARD AREAS; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Delray Beach, Florida, wishes to maintain the City of Delray Beach's eligibility in the National Flood Insurance Program (NF'P); and, WHEREAS, in order to maintain such eligibility, the City of Delre. y Beach is required to enact and maintain the flood plain management measures of Section 44 CFR 6].3(e); and, WHEREAS, pursuant to these requirements, the City Council cf the City of Delray Beach, Florida, desires to enact certain modifications to the City's ordinances, and to adopt the Flood Insurance Study and the revised Flood Insurance Rate Map, which would become effective on September 30, 1982. NO~;, THEREFORE,. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, A5 FOLLOWS: Section 1. That the Flood Insurance Study for the City of Delta} Beach, Florida, dated March 31, 1982, and the revised Flood Insurance Rate Map, revised and effective September 30, 1982, be, and the same are hereby adopted by reference, effective September 30, 19 ~2. Section 2. That Section 9-416, "Definitions", of the Code oi Ord~.nances of the City of Delray Beach, Florida, is hereby amended by repealing the definition of "habitable floor". Section 3. That Section 9-416, "Definitions", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended by adding the definition of "floor", to read as follows: Floor means the top surface of an enclosed area in a building (including basement), i.e., top of slab in concrete construction or top of wood flooring in wood frame construction. The term does not include the floor of the garage used solely for parking vehicles. Section 4. That Section 9-416, "Definitions", of the Code of OrCinances of the City of Delray Beach, Florida, is hereby amended by adding the definition of "coastal high hazard area", read as follows: Coastal High Hazard Area means the area subiect to high velocity waters caused by, but not limited to, hurricane wave wash or tsunam.is. The area is designated on a FIRM as zone Section 3. That Section 9-t~21, "Basis for establishing areas of special hazard", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: The Flood Insurance Rate Map revised as of September 30~ 1982 -.l~t~/-14r4-97-~rand any revisions thereto, identifying areas of special flood hazard by the Federal Insurance Administration, is hereby adopted by reference and declared to be a part of this article. Said map is on file in the office of the city clerk. Section 6. That Section 9-#35, "Duties of official", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended by adding new subsections (k) and (l) to read as foUows: (k) In Coastal High Hazard Areas certification shall be obtained from a registered professional engineer or architect that the structure is securely anchored to adequately anchored pilings or columns in order to withstand velocity waters and hurricane wave wash. (1) In Coastal High Hazard Areas the chief building official shall review plans for the adequacy of breakaway walls in accordance with Seciton Section 7. That Section 9-t~9, "Specific standards", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to add a new subparagraph (d), to read as follows: (d) Coastal High Hazard Areas (V zones): Located within the areas of special flood hazard established in this Article, are areas designated as Coastal High Hazard Areas. These areas have special flooding hazards associated with wave wash. Therefore, the following provisions shall apply: (l) All buildings' or structures shall be located landward of the established coastal construction control line. (2) AU buildings or structures shall be elevated so :hat the lowest supporting member is located no lower than the base flood elevation level, with all space below the lowest supporting member open so as not to impede the flow of water. Open lattice work or decorative screening may be permitted for aesthetic purposes only and must be designed to wash away in the event of abnormal wave action and in accordance with this Article. (3) AU buildings or structures shall be securely anchored on pilings or columns. (q) Pilings or columns used as structural support shall be designed and anchored as to withstand ail applied loads of the base flood flow. (5) Compliance with provisions contained in Sections 9-a#9(dX2), (3), and (q) shall be certified to by a professional engineer or architect. (6) There shall be no fill used as structural support. (7) There shall be no alterations of sand dunes or mangroves stands which would increase potential flood damage. (8) Lattice work or decorative screening shaU be allowed below the base flood elevation provided they are not part of the structual support of the building and are designed so as to break away, under abnormally high tides or wave action, without damage to the structuaJ integrity of the building on which they are to be used and provided the following design specifications are met: 2 ORD. NO. 61-g2 (i) No solid walls shall be allowed. (ii) Material shall consist of wood or mesh screening only. (9) If aesthetic lattice works or screening are utilized, such enclosed space shall not be used for human habitation. (10) Prior to construction, plans for any structure that will have lattice work or decorative screening must be submitted to the chief building official for approval. (11) Prohibit the placement of mobile homes, except in an existing mobile home park or existing mobile home subdivision. (12) Any alteration, repair, reconstruction or improvement to a structure shall not enclose the space below the lowest floor except for a lattice work or decorative screening, as provided for in Section 9-~#9(dXg) and (9). Section 8. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 9. That this ordinance shaft become effective immediately upon its passage on second and final reading.
