COONCIL CHAMBER
September 29, 1941
The City Council met in adjourned regular session at 7:?/) P.M.
with t he City Attorney and all members of the Council present.

The Clerk submitted the application of John B. Reid for license
to operate a Bar & package Store on Lot 1 Block 1 Ocean Park Subdivision,
on the Beach Blvd. This was submitted with letter and references from
Mr. Reid. Also application of George 11. Smith was presented asking for
package store license at ll9 South Dixie, on Lot 1 Block 109, Required
checks, covering license fees accompanied both of the se applications, and
tre Clerk was therefore instructed to advertise said applications, and lay
them over for the required two weeks' investigation by the City Council.
It was moved by Councilman Sabath that Mr. Smith be asked to furnish
references similar to those supplied by Mr. Reid, and he added that he
believed the CitJ' should pass an ordinance limiting the nunber of places
pennitted in tcwm, as he considered they were growing out of proportion
to Delray's population. Mr. Hill seconded Mr. Sabath' smotion, and on
roll call the vote was as follows: Mr. Hill yes, Mr. Jacobs yes, Mr.
Miller yes, Mr. Sabath yes, Mr. Scott yes. The motion carried.

On motion regularly made seconded and carried the following
ordinance was placed on its first reading:

AN ORDINANCE OF THE CITY COUNCIL OF 'lHE CITY OF DELRAY
BEACH, FLCRIDA, CALLING FOR A PRIMARY EIECTION ID NOMINA'm
CANDIDATES FOR '!HE OFFICE OF CITY COUNCILMAN IN GROUPS
A,B AND C, PROVIDING HOW OANDIDA'mS THEREIN SHALL QUALIFY
FOR SUCH PRIMARY ELECTION, AND APPOINTING A CLERK AND
INSPECIDRS TO HOLD SAID ELECTION.
The City tl.ttorney stated he had made only one principal change
from last year 'S brdinance; that heretofore the man having only a
plurality vote in t he primary was carried over titlo the general. election,
but that under this year's ordinance the two high men in the primary
would run it off in the general election, unless one candidate should
have a clear majority, in which case his name only would appear on
the General Election Ballot.
Mr. Jacobs questioned this method, but it was finally' moved by
Mr. Miller that the ordinance be passed on its first reading. Mr. Sabath
seconded the motion and on roll call the vote was as follows: Mr. Hill
yes, Mr. Jacobs yes, ]{lI'. Miller yes, Mr. Sabath yes, Mr. Scott yes, The
motion carried.

The Mayor asked Mr. Schrader, member of the Contractors Examining
Board, if the contractors and Board were prepared to go into the IlBtter
of examination requireJrents and licenses to be charged for the cominS
year. Mr. Schrader stated the contractors were present at the meeting
for toot purpose, but due to the illness of the Building Inspector, the
one most familiar with the situation, they now requested that the City
Council grant the contractors and builders a 30-day extension of time
so that they might meet in informal session, as soon as Mr. Sinks is
able to t>e present, and thresh out the entire matter to the satisfaction
of the contracto1l8 as well as the Inspector and City COUllcil. It was
therefore moved by "Ur. Sabath that the requested 3tl-day extension be
granted, for the pa;Y'mfmt of licenses, by contractors. Mr. Hill seconded
the motion and roll call the vote was as follows: Mr. Hill yes, Mr. Ja;'obs
yes, Mr. Miller ;yes, Mr. Sabath yes, Mr. Scott yes. The Motion carried.

Gentlemen:
I respectfully request permission to supply and have
erected suitable directing signs at the intersection of ~
South Swinton Avenue and Germantown Road indicating the,.way
to Military Trail. I would much prefer that these new signs
be attached to and made a part of the existing street signs."-

It was moved by Mr. Hill that the requested permission be granted.
Mr. Jacobs seconded the motion, which carried unanimously on roll call.
The matter of having cocoanuts rerr~ved from trees in the City streets
was mentioned and the need of having this done at once was stressed.
The Mayor reported that the walks around the swimming pool could be ,j)
replaced with broken flagging for about $135.00 less than the cost of new paving.
Host of the members were unfavorable to this type of paving around the pool and it
was therefore specified that solid new pavement be used.

Mr. Sabath moved that the City take out liability insurance for the swimming
pool, but this motion was lost for want of a second.
The Budget then came up for discussion. 1~. Miller expressed himself in
regard to the G~lf Course appropriation, stating he considered there should be a
reduction in same, inasmuch as appropriations for nearly all other city improvements
which he considered badly needed had been drastically cut in an effort to reduce the
tax levy, whereas no such cut had been made on the Golf course. After some further
discussion, however, it was moved by Mr. Hill that the operating tax levy f.or <
Wards I and 2 be set at 12 mills, II 3/4 mills being for general operation purposes
and ~ of a mill for repayment of the Golf course debt to the Water Fund; that the
Bond Debt for Ward 2 be set at 10 mills, and for Ward I at 2 mills. He also added
that he would like to see any surplus moneys which may come in from un-anticipated'
sources, applied to street improvements. Mr. Sabath seconded A~. Hill's motion,
and on roll call the vote was as follows: Mr. Hill yes, Mr. Jacobs.yes, Mr. Miller
voted yes but wanted to go on record as protesting an.v new additions to the
Golf Course, Mr. Sabath yes, Mr. Scott yes. The motion carried.
By motion regularly made, seconded and carried, Council regularly adjourned.
