10-10-41 Special :18:12 COUNCIL CHAMBER OCTOBER ~O, 19 '{, THE COUNCIL MET IN SPECIAL SESSION, ON CALL OF THE MAYOR AT77:30 P. M. F.RIOAY, OCTOBER 10TH, FOR THE PURPOSE OF FURTHER OISCUSSING WITH MR. EDWARDS AND MR. RILEY OF BESSEMER PROPERTIES, INC. THE PROPOSITION OF SUPPLYING WATER TO RESIDENTS OF THE TOWN OF GULFSTREAM. \ BEFORE ENTERING INTO THIS OISCUSSION, HOWEVER, THE COUNCIL LISTENED TO A COMPLAINT OF A. F. BAGGETT WHO PROTESTED AGAINST NEGROES BEING PERMITTEO ACCESS TO LOT 26 BLOCK 40, GROVE PARK SUBDIVISION. IT WAS EXPLAINED THAT THIS LOT, WHICH ORIGINALLY HAD A HOUSE ON IT, WAS SOLD BY THE CITY TO A COLORED WOMAN WHO HAD SUBSE~UENTLY MOVED THE HOUSE OFF TO N. W. 2ND STREET, COLORED TOWN, BUT WHO STILL RETAINED OWNERSHIP TO THE VACANT LOT AND THE SMALL GROVE OF GRAPE FRUIT TREES THEREON. MR. BAGGETT STATED THAT OWNERSHIP OF PROPERTY IN SAID BLOCK, BY A MEMBER OF THE COLORED RACE, WAS CONTRARY TO DEED RESTRICTIONS AND WAS NOT PERMITTED. HE ASKED THAT THE CHIEF OF POLICE BE INSTRUCTED TO NOTIFY COLORED PEOPLE TO STAY OFF THE LAND. THE MAYOR AGREED TO LOOK INTO THE COMPLAINT AND, ASKED MR. BAGGETT TO ALLOW THE C~TY TIME TO DO THIS, BEFORE TAKING ACTION IN THE MATTER. '\ A LONG DISCUSSION THEN ENSUEO IN REGARD TO THE GULFSTREAMWATER SITUATION, AND A FURTHER TENTATIVE AGREEMENT WAS SUBMITTED BY THE BESSEMER COMPANY IN WHICH THEY AGREED TO RUN WATER LINES APPROXIMATELY 1029 FEET NORTH OF DELRAY&S CITY LIMITS, AND TO OBTAIN A FRANCHISE THEREFOR FROM THE TOWN OF GULFSTREAM, WHICH WATER SYSTEM THEY PROPOSED TO TURN OVER TO THE CIT~~F DELRAY BEACH, THE CITY THEN TO SERVICE AND BILL GULFSTREAM CONSUMERS JUST AS IT DOES DELRAY BEACH RESIDENTS, EXCEPT THAT THE PRICE SHALL BE A FLAT 28 CENTS-PER-THOUSAND-GALLONS. IN CONSIDERING THIS PROPOSAL, MEMBERS EXPRESSED THEMSELVES AS BEING UNFAVORABLE TO TYING THE CITY UP TO ANY DEFINITE PROPOSITION OF THIS KIND. COUNCILMEN SABATH AND JACOBS SAID THEY WOULD NOT WANT TO CONTINUE SERVING GULFSTREAM RESIDENTS, AS IS BEING DONE NOW, WITHOUT A FRANCHISE, SINCE THEY BELIEVED IT TO BE ILLEGALL FINALLY, UPON THE RECOMMENDATION OF THE CITY ATTORNEY, AND THE ACCEPTANCE OF MR. RILEY, IT WAS MOVED BY COUNCILMAN HILL THAT THE CITY ATTORNEY BE AUTHORISED TO ,DRAW UP AN AGREEMENT BETWEEN THE CITY OF DEL RAY BEACH AND BESSEME~ROPERTIES. INC. WHEREBY THE CITY AGREES TO SELL TO THE BESSEMERpOMPANY, WATER AT THE CITY LINE THROUGH A 6-I~CH MASTER METER, WHICH THE BESSEMER COMPANY PROPOSES TO RE- METER TO THEIR VARIOUS GULFSTREAM RESIDENTS; AN9 FURTHER AGREEING THAT DELRAY'S METER MAN WILL MAKE THE MONTHLY READINGS ON SAID METERS FOR THE BESSEMER COMPANY, AND IN RETURN FOR SUCH SERVICE THE BESSEMER COMPANY SHALL PAY THE CITY OF DELRAY BEACH A MONTHLY METER MAINTENANCE CHARGE AMOUNTING TO THE TOTAL COMBINED CHARGES \ :181-3 r~ ( ! MILLER SECONDED THE MOTION AND ON ROLL CALL THE VOTE WAS AS FOLLOWS: MR. HILL YES, MR. JACOBS YES, MR. MILLER YES, MR. SABATH YES, MR. SCOTT YES. THE MOTION CARRIED. MR. RILEY ANO MR. EDWARDS THEN LEFT, EXPRESSING THEMSELVES AS BEING ENTIRELY SATISFIED WITH THIS PROPOSED ARRANGEMENT AND THANKED THE MEMBERS FOR THEIR COOPERATION AND DECISION IN THE MATTER. :; I, THE MAYOR ANNOUNCED THAT HARRY BLANK, WHO HAS ACTED AS GOVERNMENT PLAY~ GROUND SUPERVISOR FOR THE PAST YEAR HAD BEEN NOTIFIED OF THE TERMINATION OF SAID PROJECT, AND MR. SCOTT ASKED THE MEMBERS WHAT THEY WANTED TO 00 IN RE- GARO TO EMPLOYING MR. BLANK AS TAX ASSESSOR, AS PREVIOUSLY DISCUSSED WITH HIM. AFTER CONSIDERATION, IT WAS MOVED BY COUNCILMAN SABATH THAT MR. BLANK BEEEM- PLOYED BY THE CITY FOR A PERIOD OF ONE MONTH, AT THE SAME REMUNERATION AS HAS BEEN PAID HIM ON THE PLAYGROUNO PROJECT, VIZ $86.00 PER MONTH. FOR THE PURPOSE OF MAKING SOME TRIAL ASSESSMENTS OF VARIOUS TYPES OF CITY PROPERTIES, TO BE SELECTED BY THE CITY CLER~, OR ANY OTHERS THAT MR. BLANK MAY CHOOSE TO SUBMIT, SO THAT THE COUNCIL MAY HAVE SAMPLES OF HIS WORK TO JUDGE FROM. r-r ( ( , t.,j MR. HILL SECONDED MR. SABATH'S MOTION, AND ON ROLL CALL THE VOTE WAS AS FOLLOWS: MR. THE CLERK WAS INSTRUCTED TO WRITE A LETTER OF THANKS TO THE OCEAN CITY LUMBER COMPANY AND THE DELRAY LUMBER COMPANY FOR THE BICYCLE RACKS DONATED FOR USE AT THE BEACH. J' ( COUNCILMAN HILL SAID THE CITY OF DELRAY 8EACH HAD NO ORDINANCES OR LEGAL MEANS OF ENFORCING THE STATE TRAFFIC AND DRIVERS' LAWS. MR. NOWLIN INFORMED HIM THAT HE HAD BEEN RE~UESTED TO DRAW SUCH AN ORDINANCE ANO WOULD HAVE SAME READY TO PRESENT AT THE NEXT REGULAR MEETING OF THE COUNCIL. MR. SABATH REPORTED ~HAT THE CHIEF OF POLICE HAD ALSO ASKED THAT AN ORDINANCE BE ORAWN REGULATING USE OF THE CITY DOCKS, TO BE ENFORCED BY THE C CITY OOCKMASTER.
