THE PURPOSE OF APPROVING AND ACCEPTING THE 1941 TAX ROLL AS COMPLETED
BY THE TAX ASSESSOR.

FOLLOWING ITEMS OF BUSINESS WERE FIRST.TAKEN UP AND ACTED UPON BY THE

MR. C. Y. BYRD WAS PRESENT AND OFFERED AN AMENDMENT TO SECTION
4 OF PROPOSED ORDINANCE 416, WHICH AMENDMENT RECEIVED THE UNANIMOUS APPROVAL
OF THE COUNCIL AND IT WAS THEREFORE MOVED, SECONDED AND CARRIED THAT THE
ORDINANCE, AS FOLLOWS BE SO AMENDED AND PLACED ON ITS SECOND READING:

AN ORDINANCE GRANTING PERMISSION TO THE AMERICAN TELE-
PHONE AND TELEGRAPH COMPANY TO CONSTRUCT, OPERATE AND i. .,
MAINTAIN LINES OF TELEPHONE AND TELEGRAPH UPON, ALONG,
ACROSS, OVER AND UNDER THE PUBLIC ROADS, STREETS HIGHWAYS
AND OTHER PUBLIC WAYS OF THE CITY OF DELRAY BEACH, FLO-
RIDA, UNDER THE TERMS SPECIFIED HEREIN.

THE AMENDED ORDINANCE HAVING BEEN READ IN FULL, IT WAS MOVED
BY MR. MILLER THAT IT BE ADOPTED ON ITS SECOND AND FINAL READING. MR.
HILL SECONDED THE MOTION WHICH CARRIED UNANIMOUSLY. IT WAS FURTHER RE-
COMMENDED THAT A REFERENDUM ELECTION BE CALLED ON THE GRANTING OF SUCH
FRANCHISE TO THE AMERICAN TELEPHONE COMPANY, SAID ELECTION TO BE HELD
CONCURRENTLY WITH THE CITY PRIMARY ELECTION IN NOVEMBER. THE CITY ATTORNEY
APPROVED OF THIS PLAN AND AGREED TO PREPARE THE NECESSARY NOTICE ADVERTISING
SUCH ELECTION.
MR. JACOBS EN~UIRED AS TO THE POLICY OF THE COUNCIL IN REGARD
TO THE WEEDING AND CUTTING OF GRASS IN ALLEYS, STATING THAT MRS. LAIN
HAO RE~UESTED THAT THIS BE DONE IN THE ALLEY AT THE REAR OF HER PROPERTY
IN BLOCK 59. IT WAS STATED THAT THE CITY HERETOFORE HAO ONLY CLEAREO
RIGHT-oF-WAYS WHERE OENSE GROWTH TENDED TO INTEREFERE WITH SEWER LINES
OR THE PUBLIC USE OF SUCH ALLEYS; THAT NO ATTEMPT HAD BEEN MADE TO CUT
ORDINARY WEEDS OR GRASS.
MR. JACOBS ALSO BROUGHT UP THE MATTER OF E. C. HALL'S COMPLAINT
IN REGARD TO CLEARING AND FILLING OF PROPERTIES ADJACENT TO HIS NEW HOME
ON N.E. FIRST COURT, ANO STATED THAT THERE WAS CONSIDERABLE LAND TNtfHAT
VICINITY WHICH HAD ALWAYS BEEN LOW, AND UNLESS THE ENTIRE AREA WAS ORDERED
FILLED HE DID NOT SEE HOW ONE OWNER COULD BE COMPELLED TO FILL HER PROPERTY.
HE 010 RECOMMEND, HOWEVER, THAT THE CITY CLEAR OFF THE GROWTH AND CUT THE
GRASS ON THE PUBLI~~JQRT-OF-WAYS. AND HE FURTHER RECOMMENDED THAT A MAN
BE PERMANENTLY EMPLOYED TO KEEP SIDEWALKS AND STREETS CLEARED ALL OVER
TOWN, DURING THE COMING SEASON.

TAX ROLLS PREPARED ANO COMPLETED BY THE TAX ASSESSOR, MAE W. CRAMP, AND
CHECKED ANO E~UALIZED BY THE BOARD, WERE SUBMITTED FOR FINAL APPROVAL
DF THE COUNCIL. THE CLERK ALSD SUBMITTED LETTERS FRDM THE FOLLOWING
BEACH PRDPERTY OWNERS WHO CDMPLAINED THAT THEIR ASSESSED VALUATIONS HAD
BEEN UNDULY RAISED FDR 1941. THE BOARD, UPDN REVIEWING THE ROLL, WAS DF
THE DPINION THAT THESE ASSESSMENTS WERE IN LINE AND THAT THE PRDPERTIES
HAD BEEN E~UITABLY ASSESSED IN COMPARISON WITH OTHER PROPERTIES IN TDWN.
IT WAS RECOMMENDED THAT THE CLERK WRITE THESE OWNERS EXPLAINING THE REASON
FOR THE TAX RAISE ON BEACH PROPERTIES AND ASSURJNG THEM THAT IT IS THE
COUNCIL'S INTENTION AND AIM TO E~UALIZE AND ADJUST DISCREPANCIES NEXT YEAR
BY A SCIENTIFIC APPRAISAL OF THE ENTIRE TDWN.

ATIDN IN THIS EVENT, SCHEDULED FOR OCTDBER 31sT. Me. EDWARDS ESTIMATED
THE COST WDULD RUN AROUND $120.00 TD $150.00, AND ASKED IF THE CITY
WOULD NOT CONTRIBUTE TD SAME. IT WAS ACCDRDINGLY MOVED BY MR. HILL
THAT THE CITY DDNATE $25.00 TOWARDS THE CELEBRATION. MR. MILLER SECONDED
THE MDTIDN AND ON ROLL CALL, IT CARRIED UNANIMOUSLY. THE COMMITTEE
ALSD RE~UESTED THE MAYOR TD ACT AS ONE OF THE JUDGES.
MR. MILLER PRESENTED A CDMPRDMISE PLAN AND SKETCH FOR THE
PAVING OF THOMAS STREET, WHICH HE SAID HE HAO DISCUSSED WITH MR. Fox
AND HDPED TO OBTAIN HIS FINAL APPROVAL ON. THE COST OF SUCH IMPRDVEMENT,
WAS ESTIMATED AT $2,500.00 IF DONE DN A CHAS BASIS OR $2,750.00 ON THE
ASSESSMENT PLAN BASIS.

THE CLERK REPORTED THAT MRS. TIPPINS HAD INTIMATED SHE WOULD
BE WILLING TO DONATE NECESSARY PROPERTY FOR STRAIGHTENING THE ALLEY
THROUGH THE NORTH END OF BLOCK 109, PROVIDED SHE WAS RELIEVED OF ANY
ASSESSMENT FDR THE IMPROVEMENT OF SAID ALLEY. MR. MILLER STATED IT WAS
NOT THE POLICY OF THE CITY TO MAKE A DEA~ OF THIS KINO AND ~NLESS THE
PRDPDSED ALLEY WAS OF BENEFIT TO THE ABUTTING PROPERTY OWNERS AND THEY
WERE WILLING TO PAY THEIR PRO-RATA SHARE OF THE COST, HE SAW NO REASON
FOR THE CITY TO MAKE SUCH IMPROVEMENT AT THIS TIME.
JT WAS REPORTED THAT DELL AND DEL IDA PARK RESIDENTS COMPLAINED
OF BEING UNABLE TO USE SIDEWALKS IN THESE SUBDIVISIONS BECAUSE THEY WERE
NOT CONNECTED AND IT WAS NECESSARY TO WALK THRDUGH SANDSPURS IN CRDSSfNG
FRDM DNE SECTION OF SIDEWALK TO ANOTHER. MR. MILLER THOUGHT THIS SHOULD
SOMEHDW BE REMEDIED.
