AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ZONING AND PLACING LAND WHICH IS PRESENT-
LY ZONED LI (LIGHT INDUSTRIAL) DISTRICT, IN SAD (SPECIAL
ACTIVITIES) DISTRICT, BEING A 7 ACRE PARCEL OF LAND
LOCATED NORTH OF THE C-15 CANAL, BETWEEN 1-95 AND CON-
GRESS AVENUE, SAID LAND BEING IN SECTION 30, TOWNSHIP 46
SOUTH, RANGE 43 EAST; GRANTING CONDITIONAL USE AND SITE
AND DEVELOPMENT PLAN APPROVAL AND AMENDING "ZONING MAP OF
DELRAY BEACH, FLORIDA, 1977".
WHEREAS, the Planning and Zoning Board, at the meeting held on
October 18, 1982, recommended rezoning and placing land presently zoned LI
(Light Industrial) District in SAD (Special Activities) District, with
certain express conditions; and,
WHEREAS, the City Council has determined that such change should
be made,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the following described property in the City of
Delray Beach, Florida, is hereby rezoned and placed in the SAD (Special
Activities) District as defined in Chapter 30 of the Code of Ordinances of
the City of Delray Beach, Florida, to-wit:
Commencing at the Southeast (SE) corner of Section 30,
Township 46 South, Range 43 East, Palm Beach County,
Florida; thence run N 89°55'53" W 700.10 feet along the
south line of said Section 30 to a point of intersection
with the west right-of-way line of the Seaboard Coastline
Railroad; thence run N 00°18'55" W 120.00 feet along said
west right-of-way line to a point of intersection with
the north right-of-way line of the C-15 Canal; thence run
N 89~55'53" W 395.01 feet along said north right-of-way
line to a point of intersection with the east right-of-
way line of Congress Avenue as now constructed and in
use; thence run N 00~18'55'' W 1393.85 feet to a point,
which is the Point of Beginning; thence continue N 00~18'
55" W 771.93 feet along said east right-of-way line to a
point; thence run N 89°12'30" E 395.01 feet to a point of
intersection with the west right-of-way line of the
Seaboard Coastline Railroad; thence run S 00~18'55" E
771.93 feet along said west right-of-way line to a point;
thence run S 89°12'30'' W 395.01 feet back to the Point of
Beginning, containing 7 acres, more or less.
Section 2. That conditional use and site and development plan
approvals for the subject property described in Section 1, above, are
hereby granted subject to the following expressed conditions:
(a) The only conditional uses to be permitted hereunder
are as follows:
Office, research and prototype development.
(b) Prior to development of this property and receiving
any building permits therefor, the subject develop-
ment is required to be platted in accordance with
the City Subdivision Ordinance, Chapter 24 of the
Code of Ordinances.
(c) That the developer shall construct a right turn lane
on Congress Avenue pursuant to Palm Beach County
requirements.
(d) That all signs and pavement markings constructed or
erected by the developer must be in accordance with
MUTCD specifications.
(e) The drainage of the subject project shall be main-
tained on site or out through the storm sewer system
and no drainage will be allowed to flow over land
onto adjacent property.
(f) There will be no dumpsters, cluster boxes, trees,
shrubs or structures permitted on any easements or
rights-of-way shown on the plat.
(g) This approval is subject to the requirement that all
irrigation for this project shall be from a source
other than City water, if such water is suitable for
irrigation.
(h) The developer must obtain a variance to reduce the
number of required parking spaces in the reserve
parking area.
(i) That the lift station shall be enclosed with a
wooden fence and landscaping.
(J) The developer shall install a hedge along the perim-
eter to screen parking from the public rights-of-
way.
(k) That the developer shall comply with requirements of
The Standard Building Code, relative to the .required
number of handicapped parking spaces.
(1) That the building elevation shall be 15.35 feet more
or less.
(m) That prior to final site plan approval, the devel-
oper shall obtain a vacation and abandonment of the
drainage easement on the northerly end of the sub-
3ect property.
Section 3. That the development of the property described in
Section 1 is to be in accordance with the approved site and development
plans re: Congress Plaza at Delray, Delray Beach, Florida, prepared by
Sanders Planning Group, 2425 E. Commercial Boulevard, Suite 101, Fort
Lauderdale, FL 33308, Sheets SP4 and SP5 dated September 14, 1982; and
prepared by Daniel Carnahan Consulting Engineers, Inc., 101 N. State Road
7, Margate, Florida 33063, Sheets C-1 and C-2 dated September 13 and 14,
1982 respectively; all of which are incorporated by reference and made a
part hereof and upon which the City has relied in granting this approval.
Section 4. That the time limitation of this approval pursuant to
Section 30-21(E) and 30-22(E) of the Zoning Code shall be eighteen (18)
months from the effective date of this ordinance.
Section 5. That the Planning Director of said City shall, upon
the effective date of this ordinance change the Zoning Map of Delray
8each, Florida, to conform with the provisions of Section 1, hereof.

Section 6. That any building permits issued by the City shall b~
subject to substantial contruction, consisting of footings and slabs as
minimum, being accomplished by the developer within 120 days of building
permit issuance, otherwise said building permits to be null and void in
the absence of the aforesaid construction progress.
Section 7. That this ordinance shall become effective ten days
after passage on second and final reading.
