99-82 ORDINANCE NO. 99-82 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ZONING AND PLACING LAND WHICH IS PRESENTLY ZONED RM-15 (MULTIPLE FAMILY DWELLING) DISTRICT, IN SAD (SPECIAL ACTIVITIES) DISTRICT, BEING A 0.92 ACRE PARCEL OF LAND LOCATED AT THE NORTH- WEST CORNER OF LINTON BOULEVARD AND CONGRESS AVENUE, SAID LAND BEING IN SECTION 19, TO~SHIP 46 SOUTH, RANGE 43 EAST; GRANTING CONDITIONAL USE AND SITE AND DEVELOPMENT PLAN APPROVAL AND AMEND- ING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1977". WHEREAS, the Planning and Zoning Board, at the meeting held on October 18, 1982, recommended rezoning and placing land presently zoned RM-15 (Multiple Family Dwelling) District, in SAD (Special Activities) District, with certain express conditions; and, %~EREAS, the City Council' has determined that such change should be made, N~, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the following described property in the City of Delray Beach,~ Florida, is hereby rezoned and placed in the SAD (Special Activities) District as defined in Chapter 30 of the Code of Ordinances of the City of Delray Beach, Florida, to-wit: A parcel of land lying in the South half (S½) of Section 19, Township 46 South, Range 43 East, Palm Beach County, Florida, said parcel being more particularly described as follows: Begin- ning at the intersection of a line 53.00 feet North of, as meas- ured at right angles, and parallel with the South line of said Section 19, said parallel line being the North right of way line of Southwest 12th Street, and a line 485.00 feet West of, as measured at right angles, and parallel with the West right of way line of the Seaboard Airline Railway, said parallel line being the West right of way line of Southwest 20th Avenue (Congress Avenue); thence South 89°59'03" West, on an assumed bearing, along the said North right of way line of Southwest 12th Street, and parallel with the said South line of Section 19, a distance of 200 feet to a point; thence North 00°12'10" West, parallel with the said West right of way line of Southwest 20th Avenue (Congress Avenue), a distance of 200 feet to a point; thence North 89"59'03" East, parallel with the said South line of Sec- tion 19, a distance of 200 feet to a point in the said West right of way line of Southwest 20th Avenue (Congress Avenue); thence South 00~12'10" East, along said West right of way line a dis- tance of 200 feet to the point of Beginning. Section 2. That conditional use and site and development plan approvals for the subject property described in Section 1, above, are hereby granted subject to the following expressed conditions: (a) The only conditional use to be permitted hereunder is as follows: A branch banking facility. (b) Prior to development of this property and receiving any building permits therefor, the subject development is re- quired to be platted in accordance with the City Subdivision Ordinance, Chapter 24 of the Code of Ordinances. (c) That all signs and pavement markings constructed or erected by the developer must be in accordance with MUTCD specifica- tions. (d) The drainage of the subject project shall be maintained on site or out through the storm sewer system and no drainage will be allowed to flow over land onto adjacent property. (e) There will be no dumpsters, cluster boxes, trees, shrubs or structures permitted on any easements or rights-of-way shown on the plat. (f) This approval is subject to the requirement that all irriga- tion for this project shall be from a source other than City water, if such water is suitable for irrigation. (g) That interval directional signs shall be provided by the developer subject to the City Engineer's approval. (h) That the developer shall construct a five (5) foot concrete block wall separating the subject property from the abutting property to the west and north. Section 3. That the development of the property described Section 1 is to be in accordance with the approved site and development plans re: First State Bank of Lantana, Delray Branch, Delray Beach, Florida, prepared by The Lawrence Group, 205 Worth Avenue, Palm Beach, FL 33480, Sheet Nos. 1, 2, and 3 dated September 14, 1982; and prepared by Blakely and Associates, Inc., 1140 Old Dixie Highway, Lake Park, FL 33403, Sheet No. 1 dated September 14, 1982 (revised); all of which are incorpo- rated by reference and made a part hereof and upon which the City has relied in granting this approval. Section 4. That the time limitation of this approval pursuant to Section 30-21(E) and 30-22(E) of the Zoning Code shall be eighteen (18) months from the effective date of this ordinance. Section 5. That the Planning Director of said City shall, upon the effective date of this ordinance change the Zoning Map of Delray Beach, Florida, to conform with the provisions of Section 1, hereof. Section 6. That any building permits issued by the City shall be subject to substantial construction, consisting of footings and slabs as a minimum, being accomplished by the developer within 120 days of building permit issuance, otherwise said building permits to be null and void in the absence of the aforesaid construction progress. Section 7. That this ordinance shall become effective ten days after passage on second and final reading.
