THE MINUTES OF THE LAST REGULAR MEETING, HELO AUGUST 26TH WERE APPROVED AS READ. PETITIONS WERE RECEIVED FROM EIGHTEEN BEACH RESIDENTS AND PROPERTY OWNERS ASKING THAT THE ZONING OF LOTS 15, 16, 17, VISTA DEL MAR BE CHANGED FROM APARTMENT HOUSE TO "An ZONE CLASSIFICATION. AFTER DISCUSS ION, IT WAS MOVED THAT THE RE~UEST BE REFERRED TO THE ZONING COMMISSION. MR. MILLER SECONDED THE MOTION AND ON ROLL CALL THE VOTE WAS AS FOLLOWS: MR. BRADSHAW YES, MR. CREGO YES, MR. HILL YES, MR. JACOBS YES, MR. MILLER YES. THE MOTION CARR lEO, AND THE RE~UEST WAS SO REFERRED. \ 'r ! COMMUNICATIONS WERE RECEIVED FROM THE CHAMBER OF COMMERCE EXPRESSING APPRECIATION FOR THE COUNCIL'S PROMPT COOPERATION IN PASS- AGE AND EXECUTION OF THE ZONING ORDINANCE, AND FOR THE NEW SIDEWALK WHICH THE CITY RECENTLY CONSTRUCTED BETWEEN THE CANAL AND THE OCEAN BOULEVARD; ALSO OFFERING ITS SUPPORT AND PUBLICITY TOWARDS ANY "CLEAN-UP Wf;EK" CAMPAIGN WHICH THE CITY MAY SPONSOR. By MOTION OF MR. CREGO THE LETTERS WERE RECEIVED AND ORDERED FI LED AND THE CLERK I NSTRUCTED TO ACKNOWLEDGE RECEIPT AND APPRECIATION FOR THE CHAMBER'S INTEREST. THE FOLLOWI NG LETTER OF RECOMMENDATION WAS RE CE IVED AND REAO: SEPTEMB ER 9TH, 1940 MEMBERS OF THE CITY COUNCIL GENTLEMEN: IN ORDER THAT IMPROVEMENTS IN THE OFFICE OF THE BUILDING INSPECTOR AND CITY ENBtNEER BE COMPLETED, IT IS RE~UESTED THAT THE COUNCIL APPROPRIATE MONIES NOT TO EXCEED SIXTY ($60.00) DOLLARS FOR NECESSARY FIXTURES AND FURN IT URE. THESE WILL INCLUDE THREE TABLES, THREE SHADES, REPAIR AND PAINTING OF THREE OF THE OLD COUNCIL CHAIRS AND A BOOK IN WHICH WILL BE KEPT RECORD PLATS FOR HOUSE NUMBE RS. 152M COUNCIL CHAMBER - SEPTEMBER 9, 1940 THIS WILL MAKE THIS ROOM COMPLETE 'AND NO FURTHER EXPENDITURES ALONG THIS LINE SHOULD BE NECESSARY IN THE NEAR FUTURE. MILLER SECONDED THE MOTION AND ON ROLL CALL THE VOTE WAS AS FOLLOWS: MR. BRADSHAW YES, MR. CREGO YES, MR, HILL YES, MR. JACOBS YES, MR. MILLER YES. THE MOTION CARRIED. A COMMUNI C.TION FROM THE COUNTY ENGINEER WAS READ WITH REFERENCE TO A CHARGE AGAINST THE COUNTY BY THE CITY IN THE AMOUNT OF #33.07 COVERING REPLACEMENT OF A TRAFFIC CONTROL CABINET OAMAGEO BY ONE OF THE COUNTY TRUCKS. INASMUCH AS THE COUNTY HAS AND DOES AT VARIOUS TIMES FURNISH E~UIPMENT AND MATERIALS WITHOUT CHARGE FOR THE CITY'S WORK PROJECTS, THE COUNCIL FELT THE $33.07 CHARGE SHOULD BE CANCELLEO. IT WAS THEREFORE MOVED BY MR. MILLER, SECONDED BY MR. HILL, AND ON ROLL CALL UNANIMOUSLY CARRIED THAT THE CITY CLERK ADVISE MR. BOYD THAT THIS HAD BEEN BILLED IN ERROR AND THAT THE CITY HAD NO INTENTION OF CHARGING SAME TO THE COUNTY. THE CLERK READ TO THE COUNCIL THE ZONING COMMISSION'S RECOMM- ENDATION ON APPLICATION FOR SPECIAL PERMIT RE~UESTED BY A. E. CASON FOR HOUSE LOCATED IN BLOCK 35, VIZ. "THAT THE RE~UEST FOR SPECIAL PERMIT BE NOT GRANTED". THE BUILDING INSPECTOR ADVISED THAT THE COMMITTEE HAD VISITED THE SITE BEFORE MAKING DECISION ON SAME. AFTER CONSIDERABLE DISCUSSION PRO AND CON AS TO ALLOWING THE RE~UESTED SPECIAL CONCESSION, IT WAS FINALLY MOVED BY MR. MILLER THAT IT BE REFERRED BACK TO THE ~ ZONING COMMISSION FOR RE-CONSIDERATION AND FURTH';:R RECOMMENDATION. MR. CREGO SECONDED THE MOTION AND ON ROLL CALL THE VOTE WAS UN~NIMOUS AND THE MOTION CARRIED. MR. C. C. TURNER ADDRESSED THE COUNCIL, IN BEHALF OF CHURCH GOERS AND RESIDENTS, REGARDING THE WATER HOLE ON THE SOUTH FEDERAL HIGHWAY, OUTSIDE THE BAPT I ST CHURCH. HE ASKED THAT THE COUNCIL RE~UEST THE STATE OR COUNTY TO RENDER SOME EARLY RELIEF BY DISPOSING OF THIS NUISANCE, WHICH IS A SOURCE OF CONTINUED COMPLAINT DURING THE RAINY SEASONS. COUNC ILMAN CREGO SAID THE PEOPLE WERE ENTITLED TO RELIEF AND IF IT COULD NOT BE OBTAINED FROM THE COUNTY OR STATE THEN THE CITY SHOULD REMEDY THE CONDITION. MR. BRADSHAW STATED HE AND THE CITY ENGINEER HAD CONTACTED THE STATE ROAD DEPARTMENT IN AN EFFORT TO HAVE SOMETHING DONE ABOUT THIS LOW SPOT BUT HAD RECEIVED VERY LITTLE ENCOUR- AGEMENT FROM THAT DEPARTME-NT. THE MATTER WAS DISCUSSED AT LENGTH AND SEVERAL M0TIONS MADE RECOMMENDING VARIOUS METHODS pF REMEDY BUT SAID MOTIONS WERE NOT PUT TO A VOTE. FINALLY, UPON RECOMMENDATION OF THE CITY ENGINEER, I T WAS MOVED BY COUNCILMAN CREGO THAT MR. CROMER BE AUTHORIZED TO MAKE A SURVEY OF THE SITUATION, AND INVESTIGATE THE POSSIBILITY OF GETTING AID FRO\! THE STATE, SUCH AS CONVICT LABOR FOR 1529 COUNCIL CHAMBER - SEPTEMBER 9, 1940 DIGC INC THE DITCH TO INSTALL A ORA IN FROM THE FEDERAL HIGHWAY TO THE CANAL. MR. MILLER SEOONDED THE MOTION, AND ON ROLL CALL THE VOTE WAS AS FOLLOWS: MR. BRADSHAW YES, MR. CREGO YES, MR. HILL YES, MR. JACOBS YES, MR. MILLER YES, THE MOTION CARRIED. CLINT MOORE MADE COMPLAINT ABOUT THE WATER HOLE ON SWINTON AVENUE, WEST OF THE SCHOOL HOUSE, CLAIMING IT WAS A TRAFFIC HAZARD. UPON RE~UEST, THE CHAIRMAN OF THE STREET COMMITTEE AGREED TO TAKE IT UP WITH COUNTY COMM1SSI.ONER BYRO IN AN EFFORT TO HAVE THE CONDITION CORRECTED. C. T. EATON AND GEO. BROCKWAY PRESENTED A REVISED PLAT OF A SUBDIVISION OF BLOCK 124. THE MEMBERS INSPECTED THE SUBMITTED PLAT AND IT WAS MOVED BY MR. CREGO THAT THE CLERK BE AUTHORIZEO TO SICN THE PLAT, PROVIDED A TEN-FOOT EASEMENT IS GIVEN FOR SEWER LINE, SUCH EASE- MENT TO EXTEND ALONG THE SOUTH LINE OF LOT 6 FROM THE ALLEY EAST TO THE EAST LINE OF BLOCK 124. MR. BRAOSHAW SECONOED THE MOTION, AND O~ ROLL CALL THE VOTE WAS AS FOLLOWS: MR. BRADSHAW YES, MR. CREGO YES, MR. HILL YES, MR. JACOBS YES, MR. MILLER NO. MR. MILLER'S NEGATIVE VOTE BEING CAST BECAUSE OF HISD"'APPROVAL OF THE NARROW 16-FOOT ALLEY ALLOWED AS ONLY ACCESS TO ,LOTS IN THE EAST HALF OF THE BLOCK. THE MOTION WAS CARRIED ON A FOUR-FIFTHS VOTE. CLINT MOORE APPEARED AT THE MEETINC TO A,SK WHAT THE CITY INTENDED TO DO IN REGARD TO DREDGING THE PROPOSED TURNING BASIN SO~TH OF TOWN, HE SAID HIS DREDQE "THE DADE" WAS COMING THROUGH THISWEEK AND' IF THE CITY SO DESIRED HE WOULD AGREE TO DIG THE BASIN, WHICH HE ESTIMATED WOULD BE APPROXIMATELY 30,000 YARDS, AT 20 CENTS A YARO ALTHOUGH HE 010 NOT GUARANTEE TO REMOVE AN AREA OF ROCK ABOUT 50 FEET S~UARE, WHICH THE CITY ENGINEER SAID EXISTED AT THE SITE. CONSIDERABLE DISCUSSION ENSUED AS TO THE DESIRABILITY OF THE BASIN, AND THE COST AND NECESSARY FINANCING OFSAME. IT WAS RECOMMENDED THAT DECISION BE DEFERRED AND THE MATTER TAKEN UP AT AN ADJOURNED MEETING TO BE HELD WEDNESDAY NI GHT, SEPTEMBER II TH. .. ~~ MR. CREGO PRESENTED AN ORDINANCE AMENDING SECTION 174 OF THE LICENSE ORDINANCE TO READ $10.00 PER DAY INSTEAD OF $50.00 PER YEAR AND MOVED THAT I T BE PLACED ON ITS FIRST READING. THERE WAS NO SECOND TP THE MOTION. MUCH DISCUSSION FOLLOYil'D AND VARIOUS MOTIONS WERE MADE AND WITHDRAWN, THE MAYOR FINALLY RE~UESTING THAT TH IS MATTER BE MADE A SPECIAL ORDER OF BUSINESS AT WEDNESDAY NIGHT'S MEETING, AND RE~UESTED THAT THE CITY ATTORNEY DRAW THE ORDINANCE IN PROPER FORM FOR PRESEN TAT ION AT SA I 0 MEET I NG. UPON RECOMMENDATION OF THE CITY CLERK, IT WAS MOVED BY MR. BRADSHAW THAT SERVICE OF L. R. BISHOP BE SUBSCRIBED FOR AT $6.00 PER MONTH, FURNISHING THE CITY CLERK'S OFFICE WITH ALL PROPERTY TRANSFERS AS RECORDED IN'THE COURT HOUSE. MR. MILLER SECONDED THE MOTION AND ON ROLL CALL THE VOTE WAS UNANIMOUS ANO THE MOTION CARRIED. UPON RECOMMENDAT ION OF THE MAYOR, IT WAS MOVED BY MR. BRADSHAW THAT THE PURCHASE OF A PAIR OF RI DING BREECHES FOR ROY BAKER BE AUTHOR- IZED. MR. HILL SECONDED THE MOTION WHICH CARRIED UNANIMOUSLY. UPON RECOMMENDATION OF THE MAYOR IT WAS MOVED BY MR. BRADSHAW THAT A BULLETIN BOARD BE PR~VIDED FOR THE POLICE DEPARTMENT TO BE PLACED OUTSIDE OF THE STATION FOR POSTING OF NOTICES AND PAPERS. MR. HILL 153(1 COUNC IL CHAMB ER - SEPTEMB ER 9, 1940 SECONDED THE MOTION, WHICH CARRIEO UNANIMOUSLY ON ROLL CALL. IT WAS MOVED BY MR. MILLER, SECONDED BY MR. CREGO AND ON ROLL CALL UNAN IMOUSLY CARRIED THAT BILLS NUMBERED 5941 TO 5982 HAVING BEEN APPROVED BY THE FINANCE COMMITTEE BE RETURNED TO THE COUNCIL AND ORDEREO PAID. THE COUNCIL DISCUSSED BRIEFLY BUDGET ALLOCATIONS AND TAX LEVY FOR THE YEAR 1940 - 1941, AND AGREEO TO MEET WEDNESDAY EVENING; IN ADJOURNED SESSION, FOR THE PURPOSE OF SETTING UP THESE FIGURES, AND ADOPT I NG NECESSARY RESOLUTIONS.
