AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
DELETING SECTION 30 -6 "P~- 6 MULTIPLE FAMILY DWELLING
DISTRICT" (F) BUILDING SETBACKS; SECTION 30-7 "RM-10
HULTIPLE FAMILY DUELLING DISTRICT" (F) BUILDING SETBACKS
AND SECTION 30-8 "P~q-15 MUTLIPLE FAMILY D$';ELLING DIS-
TRICT" (F) BUILDING SETBACKS AND ENACTING NEW SECTION
30-6 (F), SECTION 30-7 (F) AND SECTION 30-8 (F) RELATIVE
TO ESTABLISHING SPECIAL SETBACKS FOR MULTIPLE FAMILY
STRUCTURES ~EN ABUTTI[';G A SINGLE FAMILY DISTRICT; PRO-
VIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
NO~$, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1.' That Section 30-6 "P~-6 Multiple Family Dwelling
District", (F) Building Setbacks of the Code of Ordinances of the City of
Delray Beach, Florida, is hereby repealed and a new Section 30-6 (F) is
hereby enacted to read as follows:
(F) Buildin~ Setbacks
The following shall be the minimum setbacks for all
buildings and structures in this zoning district and
shall apply separately to each story:
(Stories) 1 2
(1) Front 25 ft. 25 ft.
(2) Side (Interior) 15 ft. 15 ft.
(3) Side (Street) 25 ft. 25 ft.
(4) Rear 25 ft. 25 ft.
Exception
When a parcel of land zoned P~-6 Multiple Family ~irectly
abuts a parcel of land zoned single family without any
division or separator between them, such as a street,
alley, railroad, waterway, park, or other public open
space, the following shall be the minimum setbacks on the
abutting property line of the parcel of land zoned R~-6
~o;ult~ple Family and shall apply separately to each story:
(Stories) 1 2
(1) Front 25 ft. 25 ft.
(2) Side (Interior) i5 ft. 20 ft.

Section 2. That Section 30-7 "RM-10 ~lultiple Family Dwelling
Dlstrict", (F) Building Setbacks of the Code of Ordinances of the City of
Delray Beach, Florida, is hereby repeale~ an~ a new Section 30-7 (F) is
uereDy enacted to read as follows:

shall apply separately to each story:

(1) Front 25 ft. 30 ft.
(2) Side (Interior) 15 ft. 25 ft.
(3) Side (Street) 25 ft. 30 ft.
(4) Rear 25 ft. 25 ft.
Exception
When a parcel of land zoned ~4-10 Multiple Family direct-
ly abuts a parcel of land zoned single family without any
aivision or separator between them, such as a street,
alley, railroad, waterway, park, or other public open
space, the following shall be the minimum setbacks on the
abutting property line of the parcel of land zoned RM-10
Multiple Family and shall apply separately to each story:
(Stories) 1 2 3
(1) Front 25 ft. 25 ft. 30 ft.
(2) Side (Interior) 15 ft. 20 ft. 30 ft.
(3) Side (Street) 25 ft. 25 ft. 30 ft.
(4) Rear 25 ft. 25 ft. 25 ft.
Section 3. That Section 30-8 "~M-15 Multiple Family Dwelling
District", (F) Building Setbacks of the Code of Ordinances of the City of
Delray Beach, Florida, is hereby repealed and a new Section 30-8 (F) is
hereby enacted to read as follows:
(F) Building Setbacks
The following shall be the minimum setbacks for all
buildings and structures in this zoning district and
shall apply separately to each story:
(Stories) 1-2 3-4
(1) Front 25 ft. 30 ft.
(2) Side (Interior) 15 ft. 25 ft.
(3) Side (Street) 25 ft. 30 ft.
(4) Rear 25 ft. 25 ft.

Section 4. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent 3urisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part ~eclared to be invalid.
Section 5. That this ordinance shall become effective ten days
after passage on second and final reading.
