21-81 ORDINANCE NO. 21-81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA AMENDING CHAPTER 26 "TRAFFIC" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY ENACTING DIVISION 3A "PARKING METERS" OF ARTICLE II "STOPPING, STANDING AND PARKING" WHICH SHALL CONSIST OF NEW SECTIONS 26-63 THROUGH 26-71; ENACTING SECTION' 26-63 "DEFINI- TIONS"; ENACTING SECTION 26-64 "PARKING METER ZONE" TO DESCRIBE THE AREA CONSTITUTING .THE PARKING METER ZONE; ENACTING SECTION 26-65 "DESIGNATION OF PARKING SPACES AND INSTALLATION OF PARKING METERS" TO AUTHORIZE, RATIFY AND CONFIRM THE MARKING OFF OF PARKING SPACES AND THE INSTAL- LATION OF PARKING METERS; ENACTING SECTION. 26-66 "OPERA- TION OF PARKING METERS" TO REQUIRE THE DEPOSITING OF MONEY INTO A PARKING METER IN ORDER TO LAWFULLY PARK IN A PARKING METER SPACE; ENACTING SECTION 26-67 "PARKING TIME LIMITS" TO PROVIDE THE METER CHARGE FOR PARKING IN A PARKING METER SPACE; ENACTING SECTION 26-68 "PARKING 'PERMITS" TO AUTHORIZE THE PURCHASE OF A PERMIT WHICH ALLOWS THE FREE PARKING OF A VEHICLE IN CERTAIN PARKING METER SPACES; ENACTING SECTION 26-69 "VIOLATIONS" TO PROVIDE A LIST OF VIOLATIONS RELATED TO THE USE OF PARK- ING METERS; 'ENACTING SECTION 26-70 "COLLECTIONS" TO PROVIDE FOR THE COLLECTION BY THE CITY ADMINISTRATION OF MONEY DEPOSITED IN THE PARKING METERS; ENACTING SECTION 26-71 "PENALTIES" TO PROVIDE THE PENALTIES FOR A VIOLA- TION OF A PROVISION OF DIVISION 2A; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. Section 1. That 'Chapter 2'6 ."Tr~%f!c" of' the Code of Ordinances of the City of-Delray Beach, Florida, is hereby amended by enacting Divi- sion 3A of Article II, which shall ~consist of.Sections 26-63 through 26-71, to read as follows: DIVISIO~ 3A. PARKING METER ZONES Sec. 26-63. Definitions. For the purposes of Section 26-63 through 26-71, the following words and phrases shall have the meanings given herein: (a) The words "Parking Meter" shall mean and include any mechanical device or meter not inconsistent with this ordinance placed or erected for the regulation of parking by authority of this ordinance. Each parking meter instal led shall indicate by proper legend the legal parking time established by the city and when operated shall at all times indicate the balance of legal parking time, and at the expiration of such period shall indicate illegal or overtime parking. (b) The words "Parking Meter Zone" shall mean and in- clude any restricted street upon which parking meters are installed and in operation. (c) The words "Parking Meter Space" shall mean any space within a parking meter zone, adjacent to a parking meter and which is duly designated for the parking of a single · vehicle by lines painted or .otherwise durably marked on the curb or on the surface of the street adjacent to or adjoining the parking meters. Sec. 26-64. Parking meter zone. The following named and described areas, streets or portions of streets and such other areas, streets, or portions of streets' as may hereafter be included in this section by amendment hereto, lying within the corporate limits of the City of Delray Beach, Florida, shall con- stitute a Parking Meter Zone, namely: (a) State Road A1A from Casuarina Road to Beach Drive, (b) The Atlantic Dunes Park Parking Lot, (c) The Anchor Park Parking Lot, (d) The Sandoway Park Parking Lot, (e) The parking lot located between the Andrews Avenue Fire Station and State Road A1A. Sec. 26-65. Designation of parking spaces and installa- tion of parking meters. The marking off of individual parking spaces in the parking zones described in Section 26-64 and in such other zones as may hereafter be established and the installation of parking meters in such spaces is hereby authorized, ratified, and confirmed. The placement of the meters shall be in accordance with applicable City ordinances. Sec. 26-66. Operation of parking meters. Except in a period of emergency determined by an officer of the Fire or Police Depa~rtment, or in compli- ance with the directions of a police officer, police aide or traffic control sign or signal., when any vehicle shall be parked in any parking space alongside or next to which a parking meter is located, the operator of such vehicle, shall, upon entering the said parking meter space, im- mediately deposit or cause to be deposited in said meter such proper coin of the United States as is required for such parking meter and as is designated by proper direc- tions on the meter, and when required by the directions on the meter, the operator of such vehicle, after the deposit of the proper coin or coins, shall also set in operation the 'timing mechanism on such meter in accord- ance with directions properly appearing thereon, and failure to deposit such proper coin, and to set the timing mechanism in operation when so required, shall constitute a violation of this ordinance. Upon the deposit of such coin (and the setting of the timing mechanism in operation when so required) the parking space may be lawfully occupied by such vehicle during the period of time which has been prescribed for the part of the street in which said parking space is located, pro- vided that any persgn placing a vehicle in a parking · meter space adjacent to a meter which indicates that unused time has been left in the meter by the previous occupant of the space shall not be required to deposit a coin so long as his occupancy of said space does not exceed the indicated unused parking time. If said vehi- cle shall remain parked in any such parking space beyond the parking time limit set for 'such parking.space, and if the meter shall indicate such illegal parking, then, and in that event, such vehicle shall be considered as park- ing overtime an~ beyond the period of legal parking time, and such parking shall be deemed a violation of this ordinance. - - 2 - Ord. No. 21-81 Sec. 26-67. Parking time limits. (a) The cost of parking or standing a vehicle in a parking meter space located along State Road A1A, in the parking lot east of the Andrews Avenue Fire Station,. and in the Atlantic Dunes Park parking lot-shall be twenty- five (25) cents per hour. The cost of parking or stand- ing a vehicle in a parking meter space located within the Anchor Park parking lot and in the Sandoway Park parking lot shall be twenty-five (25) cents for every two hours. (b) The only coins which the meters accept are United States quarters. (c) The parking meters shall be operated in the parking meter zones.every day between the hours of 8:00 a.m. and 6:00 p.m., including Sundays and holidays. Sec. 26-68. Parking permits. A parking permit may be purchased from the City which shall authorize the parking of the vehicle for which the' permit was acquired in any parking meter space. located within the Anchor Park and Sandoway Park parking lots without requiring the payment of money into the space's parking meter. The cost of the parking permit · shall be twenty-five dollars ($25.00) per year. Each permit shall cover the period from October 1' through September 30, and there shall be no proration, of the permit fee. The application procedure and the form of the permit shall be determined by the City Administra- tion. It shall be illegal to deface a parking permit or to transfer a parking permit from ~_he vehicle for which it was acquired to any other vehicle. Sec. 26-69. Violations. It shall be unlawful and a violation of..the provi- sions of this ordinance for any person:...?. '~ '" (a) To cause, allow, permit or suffer any vehicle regi- stered in his name to be parked overtime. (b) To-~cause, allow, permit o= suffer any vehicle regi- stered in his name to remain or be placed in any parking space adjacent to any parking meter while said meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space. (c) To cause, allow, permit or suffer any vehicle regi- stered in his nsme to be parked across any line or mark- ing of a parking meter space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings. (d) To deface, injure, tamper with, open, break, destroy or' impair the usefulness of any parking meter installed under the provisions of this ordinance. (e) To deposit or cause to be deposited in any parking meter any slugs, device or metal substance, or other substitute for lawful coins. · -3 - Ord. No. 21-81 Sec. 26-70. Collections. The City Administration shall provide for the regu- lar collection of the money deposited in said parking meters. All such money shall be deposited into the general fund of the city. Sec. 26-71. Penalties. (a) Any person violating the provisions of Section 26-69 (a) or (b) shall be subject to a fine under the terms and conditions as set forth in Sections 26-78 · through 26-8'6 of this Chapter. --(b) Any person violating the provisions of Section 26-69 (d) shall be subject to a fine in an amount not less than two hundred dollars ($200.00) and not more than one thousand dollars ($1000.00). (c) The violation of any other provision contained within Sections 26-63 through 26-70 shall result in the penalties provided in Section 1-6 of this Code. Sectiorr;2.~-, That Should any section or provision of' this ordi- nance or any p~ thereof, any paragraph, sentence, or word be declared by a Court of ~competent jurisdiction to be invalid, such decision shall not affec= the ~Iidity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
