23-81 ORDINANCE NO. 23-81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 12 "GARBAGE AND TRASH", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 12-2(b), "VIOLATIONS; PENAL- TIES", TO PROVIDE FOR SET FINES FOR FIRST, SECOND AND THIRD CONVICTIONS AND FOR REVOCATION OF PRIVILEGES OF USING THE CITY'S DISPOSAL AREA FOR THE FOURTH CONVICTION .OF FALSIFYING THE STATEMENT REQUIRED BY SECTION 12-21(a) IN ANY ONE YEAR PERIOD OF TIME; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, repeated violations of the City's ordinances regarding no fees charged to persons hauling trash generated from real property within the City limits results in large losses of money to the City; and, WHEREAS, the City Council of the City of Delray Beach wishes to encourage compliance with the ordinances regarding fees for trash hauling by instituting certain fines for repeated violations and revocation of privileges for persons who are convicted of violating such laws four times in any one year period; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 12-2(b) of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (b) Any person who falsifies a statement required by Section 12-21(a) shall upon conviction thereof be fined one hundred dollars ($100) for the first conviction, two hundred fifty dollars ($250) for a second conviction, and'five hundred dollars ($500) for a third conviction in any one year period of time and such person shall be fined five hundred"dollars ($500) and have all privileges of using th.e city's disposal area revoked indefinitely for a fourth conviction in any one year period of time. ~e~-~ess Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
