35-81 ORDINANCE NO. 35-81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING ORDINANCE 39-80 AND REZONING THE LAND DESCRIBED IN ORDINANCE 39-80 WHICH IS LOCATED IN SECTION 13, TOWNSHIP 46 SOUTH, RANGE 42 EAST FROM R1AA (SINGLE FAMILY DISTRICT) TO RM-6 (MULTIPLE FAMILY DWELLING DISTRICT) AND AMENDING THE LAND USE PLAN OF THE COMPREHENSIVE PLAN BY CHANGING THE DESIGNATION FOR THIS PROPERTY FROM SF (SINGLE FAMILY) TO MF-6 (MULTIPLE FAMILY 6 UNITS PER ACRE) PROVIDING A SAVING CLAUSE PROVIDING AN EFFECTIVE DATE'. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That this Ordinance is in regard to the following described property: The West 461 Feet, as measured at right angles, of the East three quarters (E 3/4) of the North half (N½) of the North- east quarter (NE¼) of the Southeast quarter (SE¼); and the East half (E½) of the Southwest quarter (SW¼) of the North- east quarter (NE¼) of the Southeast quarter (SE¼), less the West 198 feet of the South half (S½) thereof TOGETHER WITH the West 193 feet of the West half (W½) of the Southeast quarter (SE¼) of the Northeast quarter (NE¼) of the South- east quarter (SE¼); all in Section 13, Township 46 South, Range 42 East, Palm Beach County, Florida. Less and not including any rights-of-way of record. Containing 13 acres, more or less. Section 2. That the Land Use Plan adopted as part of the City's Comprehensive Plan September 24, 1979 is hereby amended in regard to the property described in Section 1 above by changing the designation from SF (single family) to MF-6 (multiple family 6 units per acre). Section 3. That the zoning classification for the property described ~n Section 1 above is hereby changed from R1AA (single family dwelling district) to RM-6 (multiple family dwelling district) and the Planning Director of the City is directed to make such change on the Zoning Map of Delray Beach. Section 4. That if any word, phrase, clause, sentence or part of this ordinance shall be declared illegal by a Court of competent juris- 'diction, such record of illegality shall in no way affect the remaining .portion. Section 5. That this ordinance shall become effective ten days after it is passed and adopted on the second and final reading.
