37-81 ORDINANCE NO. 37-81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 28, "VEHICLES FOR HIRE", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, BY AMENDING SECTION 28-1, "RATES CHARGED PASSENGERS" AND BY REPEALING ALL OF ARTICLE II, "TAXICAB CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY", TO REMOVE ALL PROVI- SIONS PERTAINING TO AND/OR REQUIRING VEHICLES FOR HIRE TO OBTAIN CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY, AND TO REPEAL PROVISIONS CONCERNING SUCH CERTIFICATES' TRANSFER, SUSPENSION AND REVOCATION; AND BY REPEALING SECTION 28-4, "INSPECTION OF VEHICLES", TO REMOVE THE PROVISIONS CONCERNING CITY INSPECTIONS OF VEHICLES TRANS- PORTING PASSENGERS FOR COMPENSATION; PROVIDING A SAVING CLAUSE; PROVIDING ~q EFFECTIVE DATE. WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the residents and citizens of the City of Delray Beach, Florida, to partially deregulate the taxicab busi- ness in the City by removing provisions concerning requirements for ob- taining, holding and transferring certificates of public convenience and necessity; and, ~EREAS, the City Council of the City of Delray Beach, Florida, further wishes to repeal the provisions concerning City inspections of vehicles for hire, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 2S-l, "Rates charged passengers", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: All charges for transportation services by taxicabs or other motor vehicles transporting passengers for com- pensation within the city shall be set by the individuals, firms, or corporations ee~e~e~ee-e~-~eeese~y providing such transportation services. Section 2. That Section 28-4, "Inspection of vehicles", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby re- pealed. Section 3. That Article II, "Taxicab Certificates of Public Con- venience'' (Sections 28-16 through 28-22, inclusive), of the Code of Ordi- nances of the City of Delray Beach, Florida, is hereby repealed. Section 4. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 5. That this ordinance shall become effective ten days after passage on second and final reading.
