40-81 ORDINANCE NO. 40-81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 13 , "HEALTH AND SANITATION" , OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 13-12 (b), "LANDS TO BE KEPT FREE OF DEBRIS, VEGETATION, MATTER CONSTITUTING HAZARDS; DECLARED NUISANCE", TO ADD THE WORD GARBAGE AND CLARIFYING THE INTENT OF SAID SUBSECTION; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Delray Beach, Florida, wishes to clarify the ordinances relative to requiring lands to be free of trash and filth, by including the word garbage as defined in the Code of such prohibition, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 13-12(b) of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (b) All lands in the city shall be kept free from any kind of garbage, trash or filth, and including specifically, but without limitation, any bro e-~tree limbs, leaves or branches, any uncontained garbage or refuse, or any other type of material which might conceal pools of water which create breeding grounds for mosquitoes. The existence of any such garbage, trash or filth is hereby declared to be a nuisance. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage of second and final reading.
