AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE
CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY A~IEND-
ING SECTION 30-11 GC (GENERAL COMmeRCIAL) DISTRICT,
SECTION 30-12 SC (SPECIALIZED COMMERCIAL) DISTRICT,
SECTION 30-13 CBD (CENTRAL BUSINESS) DISTRICT, SECTION
30-13.1 LC (LIMITED COMMERCIAL) DISTRICT, SUBSECTIONS (C)
"CONDITIONAL USES" TO ADD "RESORT DWELLING UNIT, SUBJECT
TO SITE AND DEVELOPmeNT PLAN APPROVAL" AND AMENDING
,
SECTION 30-8 RM-15 (MULTIPLE FAMILY DWELLING) DISTRICT,
BY REPEALING (1) OF SUBSECTION (Q) "SPECIAL USES" RELAT-
ING TO HOTELS AND MOTELS BEING ALLOWED IN THE RM-15
ZONING DISTRICT WHEN APPROVED AS A CONDITIONAL USE;
PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Board at the May 29, 1981,
meeting unanimously recommended that Subsections 30-11 (C) GC (General
Commercial) District, 30-12 (C) SC (Specialized Commercial) District,
Section 30-13 (C) CBD (Central Business) District, and 30-13.1 (C), LC
(Limited Commercial) District be amended by adding "Resort dwelling unit
subject to site and. development Plan approval" as' a conditional use, and
amending Section 30-8 (Q) ~4-15 (Multiple Family Dwelling) District by
repealing Subsection (1) relating to hotels and motels being allowed in
the RM-15 Zoning District; and,
WHEREAS, The City Council of the City of Delray Beach, Florida,
deems it to be in the best interests of the residents and citizens of the
CLty of Delray Beach to make such amendments,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30 "ZOning'', Sections 30-11 ('C) GC
(General Commercial) District, Section 30-12 (C) (SC) (Specialized Com-
mercial) District, Section 30-13 (C) CBD (Central Business) District, and
Section 30-13.1 (C) LC (Limited Commercial) District of the Code of Or-
dinances of the City of Delray Beach, Florida, is hereby amended by adding
the following subsection as a "Conditional Use":
Resort dwelling unit, subject to site and development
plan approval. These projects shall comply with the
district requirements for the RM-15 Zoning District.
Section 2. That Chapter 30 "Zoning", Section 30-8 ~4-15 (Mul-
tiple Family Dwelling) District of the Code of Ordinances of the City of
Delray Beach, Florida, is hereby amended by repealing Subsection (Q) (1).
Section 3. That should any section or provision of this or-
dinance of any portion thereof, any paragraph, sentence, or word be de-
clared by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof as a whole or part
thereof other than the part declared to be invalid.
Section 4. That Section 2 of Ordinance No. 34-81 is hereby
repealed.
Section 5. That this ordinance shall become effective ten days
after passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final reading
