Harden, City Manager GA-10.0 Purpose: The purpose of this directive is to set forth policies to implement the Florida Clean Indoor Air Act, Florida Statute ~386.201-386.2125. GA-10.1 Leaislative Intent: As stated in Florida Statute ~386.202 - "the purpose of this act is to protect people from the health hazards of second-hand tobacco smoke and to implement the Florida health initiative in s. 20, Art. X of the State Constitution." The legislation further states that - "A person may not smoke in an enclosed indoor workplace." Florida Statute ~386.204. GA-10.2 Smokina Policv: This policy shall be applicable to all City facilities. A. Definitions: Smokina means carrying or possessing any lighted tobacco product, including cigarettes, cigars, pipe tobacco, and any other lighted tobacco product. Enclosed indoor workplace means any place where one or more persons engages in work, and which place is more than fifty (50) percent covered from above by a physical barrier that excludes rain; and more than fifty (50) percent of the combined surface area of its sides is covered by closed physical barriers without regard to whether work is occurring at any given time. B. Smokina Prohibited: Smoking is prohibited in any enclosed work space including all city buildings, city vans and buses. Smoking is also prohibited outside an enclosed work area where the smoke drifts back into the work area as well as lighting up while heading for the door or carrying a cigarette back into the work area and burning butts in ashtrays. C. Smokina Permitted: Smoking will be permitted only outdoors in designated smoking areas. GENERAL ADMINISTRATION: DESIGNATION OF SMOKING AND NON-SMOKING AREAS POLICY. Page 2 D. Violations: Violations of this policy will result in appropriate disciplinary action, up to and including, termination. E. Disputes: In any dispute under this smoking policy, the rights of the non-smoker shall be given precedence. The City Manager will be the final arbitrator of any disputes and may revise this policy from time to time as deemed appropriate and in accordance with State Statutes. F. Postina of Sians: No Smoking and Designated Smoking Area Signs will be posted as necessary in the appropriate areas until the new statute regarding the prohibition of smoking in an enclosed indoor workplace becomes more familiar to the general public.
