GA-32.0 Purpose:
The purpose of this directive is to establish a procedure that provides
for the proper discretion which is to be used in the handling of
service of process.
GA-32.1 Procedure:
The service of process (the Summons and Complaint naming the City in a
lawsuit) must be affected on the City by personal service on the Mayor,
or in the Mayor's absence by personal service on the Vice-Mayor, or in
the absence of both the Mayor and Vice-Mayor by personal service on the
Deputy Vice-Mayor. The recipient shall then transmit the original of
the Summons and Complaint to the City Attorney's Office. Service of
process which names individual City officials or employees must be
affected on those individuals personally. No employee is to accept a
Summons and Complaint for another person.
All persons receiving a Summons and Complaint naming them in their
official and/or individual capacity for claims related to their City
duties and responsibilities shall immediately transmit the originals of
same to the City Attorney's Office, and such person shall also forward
a copy to the City Manager as soon thereafter as practicable.
In instances of witness subpoenas for depositions or trial, these
should be served upon the individual being so subpoenaed. However, in
the absence of such persons, each department may designate a position
and procedure which can be used to accept witness subpoenas only.
Copies of all such witness subpoenas shall be transmitted to the City
Attorney's Office. Whenever there is a doubt or question, immediately
contact the City Attorney's Office.
Each department should establish a log system showing receipt and
transmittal of those documents.
