AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 9 "BUILDINGS AND CON-
STRUCTION", ARTICLE VIII "SIGNS AND BILLBOARDS", BY
AMENDING SECTION 9-220 "PROCEDURE ON VIOLATIONS" OF THE
CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA,
BY RELETTERING PARAGRAPH (C) TO BECOME PARAGRAPH (D);
ENACTING A NEW PARAGRAPH (C) TO PROVIDE FOR A MINIMUM
FINE OF FIFTEEN DOLLARS ($15.00) PER DAY FOR ANY VIOLA-
TION OF A PROVISION OF ARTICLE VIII BY A SIGN CONTRACTOR
OR BY A PERSON FOR WHOM A SIGN IS ERECTED; PROVIDING A
SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 9 "Buildings and Construction", Article
VIII "Signs and Billboards", Section 9-220 "Procedure on violations", of
the Code of Ordinances of the City of Delray Beach, Florida, is hereby
amended by relettering paragraph (C) to become paragraph (D) and amending
it to read as follows:
(D) ~ PROSECUTION. In addition to the remedies of re-
moval set forth in (B)(1) and (2) above and to the remed~
of assessing a fine as set forth in (C) above, when the
building official determines that a violation of this ar-
ticle exists, the violator may be cited for a violation
of this article which, upon conviction, shall be deemed a
misdemeanor and the violator shall be punished in accord-
ance with section 1-6 of this Code. Each day such viola-
tion exists shall constitute a separate offense.
Section 2. That Chapter 9 "Buildings and Construction", Article
VIII "Signs and Billboards", Section 9-220 "Procedure on violations", of
the Code of Ordinances of the City of Delray Beach, Florida, is hereby
amended by enacting a new paragraph (C) to read as follows:
(C) FINES. The following remedy set forth in this para-
graph shall be followed in addition to any other remedy
provided for in this Code. In the event that any provi-
sion contained within this article is violated either by
a sign contractor or by a person for whom a sign is erec-
ted, notice of the violation shall be provided by the
building official to the violator. The notice shall ex-
plain the affirmative action needed to be taken to cor-
rect or eliminate the violation, and shall specify the
number of days, not to exceed ten (10), by which the vio-
lation must be corrected or eliminated. If the violation
is not corrected or eliminated within the number of days
specified in the notice of violation, a fine of at least
fifteen dollars ($15.00) per day and not exceeding five
hundred dollars ($500.00) per day, shall be assessed
against the violator for each day, subsequent to the last
day by which the violation was required to have been
corrected or eliminated, that the violation remains in
effect.
Section 3. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 4. That this ordinance shall become effective ten days
after passage on second and final reading.
