AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 30-6 "RM-6 MULTIPLE FAMILY DWELLING
DISTRICT" , PARAGRAPH ( F ) "BUILDING SETBACKS"; SECTION
30-7 "RM-10 MULTIPLE FAMILY DWELLING DISTRICT", PARAGRAPH
(F) "BUILDING SETBACKS"; SECTION 30-8 "RM-15 MULTIPLE
FAMILY DWELLING DISTRICT", PARAGRAPH (F) "BUILDING SET-
BACKS"; AND SECTION 30-8.3 "PRD-10 PLANNED RESIDENTIAL
DISTRICT", PARAGRAPH (F) "BUILDING SETBACKS", SUBPARA-
GRAPH (3) TO INCREASE VARIOUS BUILDING SETBACKS FOR
MULTIPLE FAMILY PROJECTS; PROVIDING A SAVING CLAUSE;
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30 "Zoning" Section 30-6 "RM-6 Multiple
Family Dwelling District", Paragraph (F) "Building Setbacks" of the Code
of Ordinances of the City of Delray Beach, Florida, is hereby amended to
read as follows:
(F) BUILDING SETBACKS
The following shall be the minimum setbacks, by total
number of floors, for all buildings and structures in
this zoning district:
(Floors) 1 2
(1) Front 25 ft. 25 ft.
(2) Side (interior) 15 ft. 15 ft.
(3) Side (street) 25 ft. 25 ft.
(4) Rear 25 ft. 25 ft.
Exception
When a parcel of land zoned multiple family directly
abuts a parcel of land either zoned single family or
h~vin~ a single family use, or a one story multiple
family structure, the setback on the contiguous property
line shall be calculated by adding to the above setbacks
one (1) foot for every two (2) feet of building hgight.
This requirement shall only apply to multi-family struc-
tures that are two (2) or more stories.
Section 2. That Chapter 30 "Zoning", Section 30-7 "RM-10 Mul-
tiple Family Dwelling District", Paragraph (F) "Building Setbacks" of the
Code of Ordinances of the City of Delray Beach, Florida, is hereby amended
to read as follows:
(F) BUILDING SETBACKS
The following shall be the minimum setbacks, by total
number of floors, for all buildings and structures in
this zoning district:
(Floors) 1-2 3
(1) Front 25 ft. ~ 30 ft.
(2) Side (interior) 15 ft. 25 ft.
(3) Side (street) 25 ft. ~ 30 ft.
(4) Rear 25 ft. 25 ft.
Exception

abuts a parcel of land either zoned single family or

Code of Ordinances of the City of Delray Beach, Florida, is hereby amended
to read as follows:

The following shall be the minimum setbacks, by total
number of floors, for all buildings and structures in
this zoning district:
(Floors) 1-2 3-4 4-~ 6-~
(1) Front 25 ft. ~ 30 ft. ~-~%~ ~-~=
(2) Side (interior) 15 ft. 25 ft. ~-~%~ ~-~%~
(3) Side (street) 25 ft. ~ 30 ft. ~-~= 8~-~=
(4) Rear 25 ft. 25 ft. ~-~ 8~-~%~
Exception
When a parcel of land zoned multiple family directly

Section 4. That Chapter 30 "Zoning", Section 30-8.3 "PRD-10
Planned Residential District", Paragraph (F) "Building Setbacks", Sub-
paragraph (3) of the Code of Ordinances of the City of Delray Beach,
Florida, is hereby amended to read as follows:
(3) Multiple Family
(a) 1-2 floors 25 ft. 15 ft. 25 ft. 25 ft.
(b) 3-4 floors 30 ft. 25 ft. 30 ft. 25 ft.

Section 5. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 6. That this ordinance shall become effective ten days
after passage on second and final reading.
