AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 8 "BOATS AND BOATING",
ARTICLE II "ANCHORING AND MOORING", DIVISION 2 "CITY
MARINA", BY AMENDING SECTION 8-43 "DOCKAGE RATES", PARA-
GRAPH (A), OF THE CODE OF ORDINANCES OF THE CITY OF
DELRAY BEACH, FLORIDA, TO INCREASE THE VARIOUS RATES FOR
DOCKAGE AT THE CITY MARINA; PROVIDING A SAVING CLAUSE;
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 8 "Boats and Boating", Article II "An-
choring and Mooring", Division 2 "City Marina", Section 8-43 "Dockage
rates", Paragraph (A), of the Code of Ordinances of the City of Delray
Beach, Florida, is hereby amended to read as follows:
Sec. 8-43. Dockage rates.
(A) Schedule. The rates for dockage at the city marina
shall be in accordance with the following schedule:
(1) Day-to-day dockage, per foot per day, without
regard to whether or not people may be living
on board or not ............... $~T~0 0.35
(2) Monthly contract of less than four (4) months'
duration:
(a) Dock use only, per foot per day ..... ~?~ 0.21
(b) If boat will require electrical and/or
water service, per foot per day ..... ~?~ 0.25
Monthly contract renewals are subject to one
hundred dollars ($100.00) deposits. --
(3) Monthly contract of four (4) months' duration
or longer:
(a) Dock use only, per foot per day ..... ~ 0.17
(b) People living on board during dockage,
with ll0-volt hookup, per foot per day . 0~6 0.20
(c) People living on board during dockage,
with 220-volt hookup, per foot per day . ~ 0.21
A monthly contract of four (4) months' dura-
tion or longer requires first and last months'
rental in advance.
(4) Minimum per day. The rates set forth above
shall be calculated based on the actual
length of a boat; however, there is hereby
established a minimum charge per day for each
category based on an assumed length of thirty-
five (35) feet.
Section 2. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten days
after passage on second and final reading.
