AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ZONING AND PLACING LAND WHICH IS PRES-
ENTLY ZONED RH (RESIDENTIAL MULTIPLE FAMILY) DISTRICT
UNDER COUNTY ZONING REGULATIONS,. IN THE CITY ZONING SAD
(SPECIAL ACTIVITIES) DISTRICT TO ALLOW 40 MULTIPLE DWELL-
ING UNITS, BEING APPROXIMATELY 4.3 ACRES, LOCATED AT THE
SOUTHEAST CORNER OF S.W. 10TH STREET AND S.W. 7TH AVENUE,
SAID LAND BEING IN' SECTION 20, TOWNSHIP 46 SOUTH, RANGE
43 EAST, GRANTING CONDITIONAL USE AND SITE AND DEVELOP-
MENT PLAN APPROVAL AND AMENDING "ZONING MAP OF DELRAY
BEACH, FLORIDA, 1977".
WHEREAS, the City Council at its regular meeting of November 10,
1981, considered the annexation and the zoning and placing of land pres-
ently in the County of Palm Beach with County zoning of RH (Residential
Multiple Family) District, in the City zoning SAD (Special Activities)
District; and,
WHEREAS, the City Council has determined that such changes should
be made,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRA¥ BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the following described property upon annexation
into the City of Delray Beach, Florida, is hereby zoned and placed in the
SAD (Special Activities) District as defined in Chapter 30 of the Code of
Ordinances of the City of Delray Beach, Florida, to-wit:
Lots 1 through 31, inclusive, of Block A of the Plat of
Ridgewood Heights, along with that portion of S.W. 7th
Avenue and S.W. llth Street abutting the subject prop-
erty, and including that portion of the 25' right-of-way
dedicated for S.W. 6th Avenue abutting the subject prop-
erty, and including the alleys internal to the subject
property, all as recorded in Plat Book 14, Page 44 of the
Public Records of Palm Beach County, Florida.
Section 2. That conditional use and site and development plan
approvals for the subject property described above are hereby granted
subject to the following expressed conditions:
(a) The only conditional uses to be permitted hereunder are as
follows:
40 multiple family dwelling units.
(b) Prior to development of this property and receiving any
building permits therefor, the subject development is re-
quired to be platted in accordance with the City Subdivision
Ordinance, Chapter 24 of the Code of Ordinances.
(c) That the drainage of the subject project shall be maintained
on site or out through the storm sewer system and no drain-
age will be allowed to flow over land onto adjacent property.
(d) There will be no dumpsters, cluster boxes, trees, shrubs or
structures permitted on any easements or rights-of-way shown
on the plat.
(e) This approval is subject to the requirement that all irri-
gation for this project shall be from a source other than
City water, if such water is suitable for irrigation.
(f) Prior to the issuance of any building permits, the developer
shall dedicate additional right-of-way for S.W. 10th Street
to a total 40' from centerline.
(g) The site must retain first inch of runoff and the developer
shall design drainage to South Florida Water Management
District standards.
(h) The developer shall provide topo for site and 100' off-site.
(i) The developer shall be required to reconstruct S.W. 7th
Avenue to a standard 50' road section.
(j) The developer shall install a lighting system.
(k) The driveways and driving lanes shall be 24' wide.
(1) The parking stalls shall be 10' x 20'.
(m) At intersections 15' radii in right-of-way and 10' radii on
interior roads shall be used.
(n) That the developer is required to seek abandonment of that
portion of S.W. 6th Avenue lying adjacent to Block "A" of
Ridgewood Heights, and also the 12 foot north-south and
east-west alley lying within Block "A" of Ridgewood Heights.
(o) That a hedge, four feet high at time of planting, be located
aIong the west property line.
(p) That the developer pay to the City, a sum of money to be
determined by the proposed "Park and Recreation Land Dedi-
cation" Ordinance, when adopted by City Council.
Section 3. That the development of the property described in
Section 1 is to be in accordance with the approved site and development
plans re: Pine Forrest, Delray Beach, Florida, prepared by Johnson Asso-
ciates, Architects - Planners, 211 Phipps Plaza, Palm Beach, Florida
33480, Sheet 1 dated 10-13-81; and prepared by Tropical Gardens, 7910 N.
University Drive, Tamarac, Florida 33321, Sheet 1 dated 9-26-81; and
Gregory C. Miklos, Architect, 880 S.W. 14th Drive, Boca Raton, Florida
33432, Sheet 1 dated 9-3-81: add prepared by Arthur V. Strock and Associ-
ates, Inc., Engineers-Planners-Surveyors, 829 S.E. 9th Street, Deerfield
Beach, Florida 33441, Sheets I and 3 dated 9-8-81 and Sheet 2 dated 9-4-81;
all of which are incorporated by reference and made a part hereof and upon
which the City has relied in granting this approval.
Section 4. That the time limitation for this approval pursuant
to Section 30-21(E) and 30-22(E) of the Zoning Code shall be eighteen (18)
month's from the effective date of this ordinance.
Section 5. That the Planning Director of said City shall, upon
the effective date of this Ordinance, change the zoning map of Delray
Beach, Florida, to conform with the provisions of Section 1 hereof.
Section 6. That this ordinance shall become effective ten days
after passage on second and final reading.
