03-80 ORDINANCE NO. 3-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, BY AMENDING SECTION 29-20(B)(3) BY EXPANDING THE DEFINITION OF "INDUSTRIAL EQUIPMENT"; BY AMENDING SECTION 29-20(B)(6) BY ADDING THE R-lA-B, PRD-4, PRD-7 AND PRD-10 ZONING DISTRICTS TO THE DEFINITION OF "RESIDENTIAL DISTRICTS"; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, at a meeting held on November 27, 1979, the Planning and Zoning Board unanimously recommended amending Section 29-20 of the Zoning Code to prohibit the parking of tractors and industrial equipment in all residential zoning districts; and, WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the residents and citizens of Delray Beach to make such amendments, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 29-20(B)(3), Regulations for the Parking, Storing, or Keeping of Commercial Vehicles, Boats, Buses, Trailers and Trucks; Definitions, is hereby amended to read as follows: (3) The term "industrial equipment" shall mean bull- dozers, cranes, drag lines, derricks, ~e~m tractors and implements, a~ heavy earth moving equipment~ tar Pots or boilers, and road grading equipment, normally used in farming? and/or heavy construction activities. Section 2. That Section 29-20(B)(6) Regulations for the Parking, Storing, or Keeping of Commercial Vehicles, Boats, Buses, Trailers, and Trucks; Definitions, is hereby amended to read as follows: (6) The term "residential districts" shall include all R-1AAA, R-iAAA-B, R-1AA, R-1AA-B, R-lA, R-iA-B, RM-6, RM-10 a~. RM-15., PRD-4, PRD-7, and PRD-10 zoning districts. Section 3. That should any section or provision of this ordi-. nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
