06-80 ORDINANCE NO. 6-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS~NDING CHAPTER 25 "TRAFFIC AND MOTOR VEHICLES" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY A~NDING AND RELETTERING EXISTING SUB- SECTION 25-1(C) TO BECOME SUBSECTION 25-1(d) AND ENACTING NEW SUBSECTION 25-1(c) TO AUTHORIZE THE ENGINEERING DE- PARTMENT TO DETERMINE THE NEED FOR OFFICIAL TRAFFIC CON- TROL DEVICES, SIGNS AND SIGNALS, RATIFYING EXISTING TRAFFIC CONTROL DEVICES, SIGNS ~D SIGNALS, SPECIFYING INSTALLATION REQUIRE~.~NTS; PROVIDING A PENALTY; PROVIDING A SAVING CLAUSE; PROVIDING ~N EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 25 "Traffic and Motor Vehicles" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended by relettering Subsection 25-1(c) to Subsection 25-1(d) and amending Sec- tion 25-1(d) to read as follows: ~e~ (d) Any person, firm or corporation who violates subsection (a) e~ (b) or (c) shall, upon conviction thereof, be punished by the same penalty as is provided by the laws of the state, but in no case shall such penalty exceed a fine of five hundred dollars ($500.00), or an imprisonment for more than ninety (90) days, or both such fine and imprisonment ~-%~e-~se~e~-e~-%he Section 2. That Chapter 25 "Traffic and Motor Vehicles" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended by enacting a new Subsection 25-1(c) to read as follows: (c) This subsection shall apply to all public: streets, alleys, highways, avenues, lanes, boulevards, roads and other like rights of way (hereinafter referred to collectively as streets) under the City's jurisdiction pursuant to Florida Statute 316 as now existing and as may hereafter be amended; and all parking lots, driveways, or other areas open for use of the public for vehi- cular, pedestrian, or bicycle traffic (hereinafter referred to collectively as public ways). (1) The engineering department is hereby authorized to in- stall, remove, or modify traffic control devices, signs or signals to regulate vehicular, pedestrian, and bicycle traffic on the streets and public ways in the City which are determined by traffic engineering study to be necessary or desirable for safe traffic control. (2) All traffic control devices, signs, and signals in existence in the City as of the effective date of this ordinance are hereby ratified and confirmed. (3) All traffic control installations hereafter made by the City shall comply with the manual and specifications of the State Department of Transportation. All traffic control devices, signs, signals erected in accordance with this sub- section 25-1(c) shall be official traffic control devices, the violation of which shall result in the penalties pro- vided in Section 1-6 of the Code. Section 3. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
