AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 9 "BUILDING CODE" OF THE
CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA,
BY REPEALING SUBSECTION 1115.5 OF SECTION 9-1 "HANDRAILS"
AND ENACTING A NEW SUBSECTION 1115.5 TO BE CODIFIED UNDER
SECTION 9-1.2, ESTABLISHING REQUIREMENTS FOR WALLS AND
HANDRAILS ON BOTH SIDES OF STAIRWAYS; PROVIDING AN EXCEP-
TION THERETO; PROVIDING A SAVING CLAUSE; PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 9, "Building Code", Subsection 1115.5 of
Section 9-1 of the Code of Ordinances of the City of Delray Beach, Florida,
is hereby repealed and a new Subsection 1115.5, to be codified under Sec-
tion 9-1.2, is hereby enacted to read as follows:
SEC. 1115.5. ESTABLISHING REQUIREMENTS FOR WALLS~D HANDRAILS
ON BOTH SIDES OF STAIRWAYS.
(a) All stairs of more than forty-four (44) inches in
width shall have walls and handrails on both sides.
The handrails shall be not less than thirty (30)
inches nor more than thirty-four (34) inches high.
(b) All stairs of forty-four (44) inches or less in width
shall have walls and handrails on both sides except
that a handrail alone may be utilized on one side
only, provided the wall on the other side directly
abuts the stair stringers. The handrails shall be
not less than thirty (30) inches nor more than
thirty-four (34) inches high.
(c) When the required width of a flight of stairs exceeds
eighty-eight (88) inches, one or more intermediate
handrails, shall be provided in addition to those
required in paragraph (a) above. These additional
handrails shall be continuous between landings, sub-
stantially supported and terminating at the upper end
in newels or standards and there shall be not more
than sixty-six (66) inches between such adjacent hand-
rails.
Section 2. That should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten days
after passage on second and final reading.
