19-80 ORDINANCE NO. 19-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29, "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY AMENDING SECTION 29-18(F)(5)(u) "OFF-STREET PARKING REGULATIONS", "MARINAS", BY CLARIFYING THE REQUIREMENTS FOR FLOOR AREA AND BY ADDING PROVISIONS REQUIRING MARINAS TO PROVIDE ONE ADDITIONAL PARKING SPACE FOR EACH BOAT SLIP; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board, at a meeting held February 15, 1980, unanimously passed a motion recommending an amendment to the Off-Street Parking Regulations for Marinas relative to providing one additional space for each boat slip; and, WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the residents and citizens of the City of Delray Beach to make such amendment, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 29-18(F)(5)(u), Off-Street Parking Regu- lations, of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (u) Marinas Five (5) per one-thousand (1,000) square feet of total floor area of any building or structure devoted to marina use, plus one (1) for each boat slip, plus one (1) per employee on shift of greatest employ- ment. Section 2. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
