25-80 ORDINANCE NO. 25-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, PURSUANT TO THE MUNICIPAL HOME RULE POWERS ACT, SECTION 166.041(3)(c)(2), REZONING NINE (9) P~RCELS OF REAL PROPERTY IN THE CITY OF DELRAY BEACH, IN IMPLEMENTATION OF THE CITY OF DELRAY BEACH COMPREHENSIVE PLAN, ADOPTED SEPTEMBER 24, 1979; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Delray Beach adopted a Comprehensive Plan on September 24, 1979, pursuant to the provisions of Chapter 163.316 of the Florida Statutes known as the Local Government Comprehensive Planning Act of 1975; and, WHEREAS, the Planning and Zoning Board and City Council of the City of Delray Beach spent many hours of study in reviewing said Compre- hensive Plan and holding public hearings thereon; and, WHEREAS, in regard to certain parcels of property there is a conflict between the Comprehensive Plan and the Zoning Map of the City; and, ~EREAS, the City Council desires to eliminate these conflicts and rezone the subject parcels to be consistent with the Comprehensive Plan; and, WHEREAS, the Planning and Zoning Board of the City of Delray Beach has held a public hearing on March 18, 1980, on the rezonings pro- posed in this Ordinance and it is the recommendation of the Planning and Zoning Board that said rezonings be adopted, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the parcels of property designated Parcels 1 and Parcels 5-12 inclusive on the attached map prepared by the City of Delray Beach Planning Department dated April 21, 1980, (which is incorporated herein by reference) are hereby rezoned to the classifications shown on said map. Section 2. That the Planning Director of the City on the effec- tive date of this ordinance shall change the official zoning map of the City to conform with the provisions of Section 1 above. Section 3. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
