05-02-39 Special 1212 COUNCIL CHAMBER May 2, 1939 j The Council met in special session at 7:30 P.M. for the purpose of considering proposed amendments to the present City Charter. The City Attorney and all members of the Council were present. Before entering into the matter of charter changes the City Clerk submi ttedand read an enquiry from the Western Union Telegraph Company, in which permission was reguested to distribute advertising matter for Sears Roe buck and Company, under the Telegraph Company's present $25.00 license. The letter explained that this was one of the company's auxiliary services and for that re'ason it was felt that additional license for distribution of ad- vertising should not be required of Telegraph companies. After discussion, it was moved by Mr. Hall that said company be required to pay the designated license for handbill distribution and that these hand bills be circu- lated only in conformity with existing city ordinances, viz. a license fee of $5.00 per day be charged and hand~ bills distributed only where consent of property owners has first been obtained in writing. Mr. Miller seconded the motion and on roll call the vote was unanimous, and the motion declared carried. I \ l Changes in sections of the City Charter hereinafter enumerated were proposed as follows: , '; :11 i ! I , Section 12: That the date of the general election held each year be changed from the third Tuesday in December to the first Tuesday in December. Section 13: Members of the City Council shall be qualified electors of the City who have paid'city taxes On real estate Within the city limits for the year pre- ceding the year in which the election is held. Section 31: An emergency ordinance may be passed and adopted at one meeting of the City Council and may take effect immediately or at such time as shall be' designated in the ordinance. Section 32: All resolutions passed by the City Council shall take effect at the time of such passage or at such time as may be indicated in the resolution. .Ii :~ I I ~ ,M .. :~i .;f<; .~. t;" x " 1-21-3 COUNCIL CHAMBER - May 2, 1939 Section 33: Every ordinance shall be published by caption only, once within ten days after its passage in a newspaper published in the City of Delray Beach, or posted in three public places in the City of Delray Beech. Section 51: The Chief of Police and other officers in charge shall have authority to take from persons arrested, a bond or other security for appearance before the Municipal Court, but n~ such bond or security shall be for less than One Dollar nor more than Five Hundred Dollars. Section 56: Any sentence imposed by the Municipal Court may be suspended by the Municipal ~udge, if such ~ suspension is made at the time the sentence is imposed. Section 93 &. Section 107: Providing authority for the sale of tax sale certificates and special assessment liens for such amount as may be fixed by resolution or ordinance passed by the city council. Also, confinnlng and ratifying the action of the City Council in the sale and assignment of delinquent tax certificates heretofore made by the City of Delray Beach, through its City Clerk. i ,; Section 131: In the event that more than'two can- didates qualify in anyone class, there shall be a primary election to nominate candidates in any such class on the third Tuesday in November. Section 132: The name of the candidate receiving the highest vote in any class i~the primary election shall be placed upon the ballot in the general municipal election. ;. 1 'I 1 I ~ ~ [ i;) ~ it ~ ij I .. ~ ~~~ Section 134: No person shall be allowed to vote in any election for the purpose of electing Council- man, who is not a qualified voter of the City, and who has not resided in the State of Florida for one year and in the City for six months immedlately preceding such eleotion. Section 153: A mO~ion w~s made by Mr. Hall to strike out the part of this section referring to owners, of a majority of the frontage of land liable to be . assessed for any special local imprOvement, to petition the City Council for such improvement. The motion was seconded by Mr. Crego and on roll call the vote was as fol.1ows: Mr. Bradshaw no, Mr. Crego yes, Mr. Hall yes, Mr: Hill yes, Mr. Miller yes. This was discussed by members of the Council who decided this matter should be referred to a representative body of citizens for discussion and an ex- pression of opinion. It was recommended by the Council that the City Attorney be instructed to draw a resolution embodying the proposed charter changes for presentation at a special joint meeting of the Council and citizens, Tuesday~ night, May 9th.
