27-80 ORDINANCE NO. 27-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY AMENDING SEC- TION 30-20 (E)(2)(a) AND (b) PERMITTED PARKING FOR BOATS, BOAT TRAILERS, AND RECREATION VEHICLES TO ALLOW ONE BOAT, ONE BOAT TRAILER, AND ONE RECREATION VEHICLE ON A PARCEL OF LAND; PROVIDING FOR EFFECTIVE SCREENING AGAINST DIRECT VIEW FROM ABUTTING PROPERTIES; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the residents and citizens of the City of Delray Beach to make such amendment, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 30-20(E)(2)(a) and (b) Permitted Parking, Boats, Boat trailers, and Recreation Vehicles, of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows (E) PEP~4ITTED PARKING (2) Boats, Boat Trailers, And Recreation Vehicles (a) One (1) boat, one (1) 'boat trailer, e~ and one (1) recreation vehicle may be parked in a garage or car- port which is effectively screened on three (3) sides, provided no portion of the boat, boat trailer, or recreation vehicle extends beyond the roof line. (b) One (1) boat, one (1) boat trailer, e~ and one (1) recreation vehicle may be parked in the side or rear yard provided the plot is occupied by a permitted structure. Such boat, boat trailer, or recreational vehicle shall be effectively screened against direct view from abutting properties in the fo..llow'.lng manner:? (1) by a masonry wall, ornamental fence, or dense hedge, six (6) feet high .whenever the height of such boat, boat trailer, or recreational vehicle is six (6) feet high or less; or (2) by a dense hedge the height of such boat, boat trailer or recreational vehicle but not exceeding ten (10) feet high, when- ever the h~eiqb~,.of .such boat~ boat trailer~ or recreational vehicle exceeds six (6) feet. This regulation is not to be construed as requiring screening from direct view from the street in front of the plot. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not af- fect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
