ORDINANCE NO. 31-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH A PARCEL OF LAND LOCATED IN SECTION 18, TOWNSHIP 46 SOUTH, RANGE 43 EAST, WHICH LAND IS CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LAND; AND PROVIDING FOR THE ZONING THEREOF. WHEREAS, Arthur W. Malernee is the fee-simple owner of the property hereinafter described; and, WHEREAS, Arthur W. Malernee has requested by his petition to haw the subject property annexed into the Municipal limits of the City of Delray Beach; and, WHEREAS, in conjunction with an annexation proceeding the City o~ Delray Beach applies a City Zoning Classification to the subject property and, WHEREAS, the City of Delray Beach has heretofore been authorized to annex lands in accordance with Section 171.044 of the Florida Statutes~ NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY O! DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council of the City of Delray Beach, Palm Beach County, Florida, hereby annexes to said City the following described land located in Palm Beach County, Florida, which lies conti- guous to said City; to-wit: A parcel of land in a portion of the Southeast Quarter of Section 18, Township 46 South, Range 43 East, Palm Beach County, Florida, being more particularly described as follows: commencing at the Northwest corner of the West one-half of the Northwest Quarter of the Northeast Quarter of the Southeast Quarter of said Section 18; said corner being in the centerline of right-of-way of Congress Avenue as now laid out and in use; thence run South 0°10'39'' East along said centerline and West line of the West one-half of the Northwest Quarter of the Northeast Quarter of the Southeast Quarter of said Section 18 a distance of 455.06 feet to a point being in the Westerly extension of the Southerly right- of-way line of State Road No. S-806 as now laid out and in use; thence run North 55°30'41'' East along said Southerly right-of-way line a distance of 113.54 feet to the beginning of a curve concave to the Southeast having a radius of 1857.08 feet and a central angle of 8~45'17"; thence North- easterly along the arc of said curve, through a central angle of 4~38'12'', a distance of 150.28 feet to the point of beginning of the hereinafter described parcel; thence con- tinue along the arc of said curve through a central angle of 4~07'05'', a distance of 133.48 feet to a point on the East line of the West one-half of the Northwest Quarter of the Northeast Quarter of the Southeast Quarter of said Section 18; thence South 0~09'39" East, along said East line of the West one-half of the Northwest Quarter of the Northeast Quarter of the Southeast Quarter, a distance of 110.67 feet to a point in the Northerly right-of-way line of old State Road No. 806 (Atlantic Avenue and Delray West Road); thence South 49°35'21'' West along said Northerly right-of-way line, a distance of 128.48 feet to a point; thence North 8°51'39" West, departing from said right-of-way line, a distance of 133.32 feet to the point of beginning subject to rights-of- way and easements of record and containing in all 0.320 acres more or less. Section 2. That the Boundaries of the City of Delray Beach, Florida are hereby redefined so as to include therein the above-described tract of land and said land is hereby declared to be within the corporate limits of the City of Delray Beach, Florida. Section 3. That the tract of land hereinabove described is hereby declared to be in Zoning District MI (Medium Industrial) District as defined by existing ordinances of the City of Delray Beach, Florida. Section 4. That the land hereinabove described shall immedi- ately become subject to all of the franchises, privileges, immunities, debts, obligations, liabilities, ordinances and laws to which lands in the City of Delray Beach are now or may be subjected and persons residing thereon shall be deemed citizens of the City of Delray Beach. Section 5. That if any word, phrase, clause, sentence or part o~ this ordinance shall be declared illegal by a Court of competent jurisdic- tion, such record of illegality shall in no way affect the remaining portion.
