The Council met in special session at 7:30 P.M. on
~ call of the Mayor, to consider phases of the zoning
ordinance and how the zoning of N.E. 4th Avenue affected
certain residents in that locality.
The City Attorney and all members of the Council
were present.

The Mayor opened the meeting by reporting that Mrs.
Titus had made complaint to him regarding the noise and dirt
from Joe Priest's place of business and that she wanted to
know if something could not be done to have it abated.

Mrs. Titus, who was present, affirmed that the build- ,
ing permit issued had been for II workshop, whe reas Mr. Priest iii'
actually was carrying on a public garage or blacksmith ~hop, i
which she considered should be nestricted to the Industrial ~
District rather than to the General Business Zone. I
Upon referring to the Zoning ordinance the City Attor-I
ney read the section governing erection of buildings in the '~
General Business Zone, and it was hi s opinion tha t the permi tl' >[:
had been issued in accord wi th the provisions of said section,.~'.'
and that such an enterprise, conducted either for private "
use or asa public business, would be allowed on said loca- f!
tion, viz. Lot 2 Block 99, the conduct of said business to be'
in compliance with and subject to occupational licenses~i
designated by the City's License ordinance. ~~

Both Mrs. Titus and Jarmin Smith alleged thR business~
was carried on at unreasonable hours, and Mrs. Titus request-'~
ed the Council to have the machine shop moved from its ~#;
present location abutting on the alley, and also that the~%
concrete manufacturing machinery be moved or operation i~

Members of the Council took the position, that if~' I
it could be shown any violation of the zoning ordinance I
existed they would be willing to comply with the request

in taking such action. They agreed ,however , to cooperate to
the extent of having Mr. Priest conduct his business during
reasonable working hours and in such a way as to be least
objectionable to adjacent residents.
There being no further business, it was regularly
moved, seconded and carried that Council adjourn.
