The Council met, at 10:00 P.M., in adjourned
special session, as a Board of E~ualization, pursuant
to a notice duly published, and according to the ordin-
ances and charter of the City. The City Attorney and the
following members were present: :Mr. Bradshaw, :Mr. Crego,
Mr. Rall, Mr. Rill and Mr. Miller.
The following letter, addressed to the Board
was received and read:

I am informed you are s i tt ing as a ,Beard
from July lOth to 13th for the purpose of'reoeiv-
ing complaints from property o\~rs on unsatisfact-
ory appraisments of their properties.
I am informed by your Oi ty Clerk you
have assessed Lot 3 Block 4 Ocean Park for 10 feet
frontage on AtJLantic Avenue which I maintain has a
frontage of 30 feet and should be assessed as Lots
1 & 2 adjoining which I own, Lots 4 & 5 Block 4
is assessed for 70 feet in depth which I claim to
90 feet in length. I hereby enter a protest against .r"
the conformation of the assessment on the above
lots and that they be assessed to me as set up on
the originaL..r p:J.at of Delray Beach, which I have
paid taxes for 16 years.

for assessment, no action was taken in ~egard to the
Sabin communication.
No other complainants appeared at the meeting
and it was reported that all applicants had been heard
and assessments equalized and adjustments made, where
warranted, said adjustments being embodied in the follow-
ing resolution, which was submitted for adoption by the
Council:

A RESOLUTION OF THE BOARD OF E Q,UALIZATION
OF TAXES
WHEREAS, the Assessor of taxes' of the City
of Delray Beach has prepared the 1939 tax assess-
ment roll of both the real and personal property
located within the-City subject to taxation and
has passed said a~aesament roll to the Qity Council
sitting as a Board of Equalization of taxes to be
e~ualized and revised,

AND, WHEREAS, a due notice of said IlIf'feting
had been given by two publications in the Delray
Beach News, a newspaper published within said City
in its issues of ;rune 23, 1une 30 and July 7th,1939,
AND, WHEREAS, said Board of E~ualization
of taxes did meet and sit on Monday, July lOth,
Tuesday, July 11th, Wednesday, July 12th, Thursday,
July 13th and finally on July 25th, 1939, and did
carefully examine, revise and equalize the valuations
shown on said assessment roll as prepared by the
Assessor of taxes for the City and did also hear
all persons who appeared before it with complaints
and did cause the Clerk to note all complaints on
the minutes of said Board,
NOW, THEREFORE, BE IT RESOLVED, By the
Board of E~ualization of taxes that the tax assess-
ment roll of the City of Delray BeaCh for the 1939
taxes as the same have been prepared by the
Assessor of ~axes and submitted to this Board be
revised as follows:
The valuation of the Nt of the st 01:,
Block II assessed to Lee Monroe is fixed at $325.00.
The vanuation of Lot 23, Block'55, assessed to
A.W. Nickols, is fixed at $300.00. The valuation
of Lot 9, Block 92, assessed to D.J". Morrison, is
fixed at $1,794.00. The assessed valuation of
Lots 16 to 28 inclusive, Block 113, is reduced

from $235.00 to $200.00 each and that the same
percentage of reduction be made on lots facing
the Federal Highway in Block 114 and Haller-
Groatman Subdivision. Th9:t the assessed valuation
of unimproved lots in Ocean Breeze Estates,
Delray Beach Esplanade and all other filled-in
muck lots East of the Florida Intracoastal Carel
be increased ten per cent over the 1938 assessed
valuation. That Lots 1, 36 and 37 and the N1;- of
Lot 2, West of the Railroad, assessed to Carl A.
Jones, be assessed at an average valuation of $100.00
per acre or a total of $6,200.00. That the assess-
ed valuation of Block 130 be fixed at $5,200.00
That the assessed valuation of Block 138 be fixed
at $2,600.00. That the following personal property
valuations be changed so as to be assessed as
follows:

BE IT FURTHER RESOLVED that the said
assessment rolls of the City of Delray Beach for
the year 1939 as the same have been equalized and
revised by the Board be and the same are hereby
approved and made the permanent 1939 tax assess-
ment rolls of the 01 ty of Delr ay Beach and the
valuations fixed on said rolls shall be final and
shall not be changed.

BE IT FURTHER RESOLVED that this Boerd has
met and heard all persons deSiring to be heard a~0
has held its meetings open from day to day and
that s aid Board does not deem it necessary to hold
any further meetings after today, in view of the'
fact that there are no other persons before it
desiring to be heard, or to file complaints.

BE IT FURTHER RESOLVED, that the assess-
ment rolls as the same have been revised and equal-
ized be returned to the Assessor of taxes with a
Certificate of the President and Clerk of the
City Council recitimg that said rolls have been
revised and e~ualized and that the valuations
fixed on ocaid assessment rolls shall not be changed.
PASSED in special adjourned session of the

Mr. Bradshaw moved the adoption of said
resolution, which motion was seconded by Mr. Crego,
and on roll call unanimously carried.
There being no further business to come
before the meeting the Council reguJa rly adjourned as
a Board of E~ualization on the 1939 Tax Roll.
