43-80 FAILED ORDINANCE NO. 43-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY AMENDING SECTION 30-7(C) (12) RM-10(MULTIPLE FAMILY DWELLING) DISTRICT TO ADD THE WORDS "MAY BE ALLOWED IN THAT GEOGRAPHICAL AREA AS DEFINED IN SUBSECTION 30-7(Q)", AND FURTHER AMENDING SECTION 30-7 TO ADD A SUBSECTION (Q) SPECIAL USES, TO READ "PROFESSIONAL OFFICES AS DEFINED IN SEC. 30-7(C) (12) ARE ALLOWED IN THE RM-10 ZONING DISTRICT WHEN APPROVED AS A CONDITIONAL USE (SEC. 30-21) AND ONLY WITHIN THE GEOGRAPHICAL AREA WHICH IS BOUNDED ON THE NORTH BY N.E. 9TH STREET, ON THE SOUTH BY N.E. 6TH STREET, ON THE EAST BY THE F.E.C. RAILROAD, AND ON THE WEST BY N.E. 2ND AVENUE"; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 30-7(C) (12) RM-10(Multiple Family Dwelling) District of the Code of Ordinances of the City of Delray Beach is hereby amended to read as follows: (12) Professional offices, limited to accountants, architects, attorneys, chiropractors, dentists, engineers, independent trustees, landscape architects, naturopaths, opticians, optometrists, osteopaths, physicians, podiatrists, psychologists, and surgeons, may be allowed in that geographical area as defined in Subsection 30-7(Q). Section 2. That Section 30-7 RM-10 (Multiple Family Dwelling) District of the Code of Ordinances of the City of Delray BeaCh is further amended by adding the following subsection to read as follows: (Q) SPECIAL USES (1) Professional offices as defined in Sec. 30-7(C) (12) are allowed in the RM-10 Zoning District when approved as a conditional use (Sec. 30-21) and only within the geographical area which is bounded on the north by N.E. 9th Street, on the south by N.E. 6th Street, on the east by the F.EoC. Railroad, and on the west by N.E. 2nd Avenue. Section 3. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
