AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 15 "LICENSES" OF THE
CODE OF ORDINANCES BY REPEALING SECTIONS 15-11 AND 15-12
AND ENACTING NEW SECTIONS 15-11 AND 15-12 TO RAISE THE
OCCUPATIONAL LICENSE FEES TO THE MAXIMUM PERMITTED UNDER
FLORIDA STATUTES 205.043; PROVIDING A SAVING CLAUSE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Occupational License fees levied by municipalities udder
Chapter 205 of the Florida Statutes have until this year been kept at the
rates chargeable in such municipalities in 1971; and,
WHEREAS, the State Legislature after this nine year freeze on
occupational license fees has provided that such fees may be increased
in accordance with the limits provided in the Legislation commonly referred
to as the "TRIM Bill"; and,
WHEREAS, the City Council ~f the City of Delray Beach desires to
implementl this authorization contained in Section 205.043 of the Florida
Statutes,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 15, "Licenses", of the Code of Ordinances
is hereby amended by repealing Sections 15-11 and 15-12 and enacting new
Sections 15-11 and 15-12 to read as follows:
Sec. 15-11. Schedule of taxes.
The following enumerated individual license tax shall be paid to
'the city by the persons engaging in or managing or transacting the several
occupations or professions named yearly, unless otherwise specified:

(1) ABSTRACTING, land title, warranty or security company.

of the license and the license tax shall be computed
on such inventory and whatever additional tax, if
any, is due, shall be paid at such time and a re-
ceipt shall be issued showing the payment of such

checked with personal property tax return for
accuracy.)
Small Stands selling tobacco, cold drinks, candies and
such sundries, having a stock of less than $200.00,
when no other license is paid, shall pay a license

Sec. 15-12. Unclassified professions and occupations.
Every business, occupation, profession or exhibition, substantial,
fixed or temporary, engaged in by any person, whether in a building, tent or
upon the street, vacant lot or anywhere in the open air within the city and
here not specifically designated shall pay a license tax of ~ ~o~½&~s

lution or ordinance of the city council.

Section 2. That should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or part thereof other
than the part declared to be invalid.
Section 3. That this ordinance shall become effective on October
1, 1980.
