05-02-38 Special ~1~ COUNCIL CHAMBER May 2, 1938 The Council met in special session, upon call of the Mayor, for discussion and action on several matters of business requiring consideration at this time. The City Attorney and all members of the Council were present. Mr. Byrd read a letter, received by him, from Mr. Mittendorf recommending that the Council defer acting under the provisions of the recently adopted tax adjustment resolution until such time as final action is taken by the Council, on the debt refunding program, recently submitted by his Committee. . Discussion ensued, in which members expressed the belief that if the Bondholders' Committee understood the situation, and knew how favorably taxpayers had responded to this plan of tax adjustment, it would not oppose it. It was considered to the best interests of the City to continue these tax adjustments and Mr. Wodischek moved that the City Attorney ~e instructed to reply to Mr. L'Engle and Mr. Mittendorf, advising that the City expected to continue to make such tax adjustments, and inviting them to investigate the manner in which taxes have been settled under said adjustment plan. Mr. GWynn seconded the motion, which carried unanimously. Dr. Vogler appeared at the meeting and enq~ired as to the management of the ball-field by The Baseball Association, requesting that said Association have author- ity to establish rules and regulations as to days and times when other teams may practise and play on the field. It was finally moved by Mr. Miller that Dr. ,ogler, President of the Association, be appointed Athletic Director, to have control of maintenance and schedules for games and pract.i.~e. on the ball diamond. Mr. Hall seconded the mo1;ion,wWl,:ti~':.." carri ed unanimously. The City Clerk was instructed to b~..,e!" .4, a notice :published announcing that those desiring to par1;,..v! icipate in games or practice on said field must apply to . the Athletic Director for permission. ;.' 't Councilman Miller reported he had conferred with members of the Library Committee and t~v they were very anxious to have an election called immediately for decision on the question of establishing a public library and reading room in this City. Dr. Love. had requested that the election be held as early in June as ~~ COUNCIL CHAMBER - May 2, 1938 " f possible. It being p~nted out that two publications of the election call were ecessary, members recommended that a resolution be adopted Ommediately. It was accordingly moved by Mr. Wodischek that resolution be adopted, as follows: ~SOLUTION 218 ROOK 4 RESOLUTION CALLING AN ELECTION TO DECIDE WHETHER A PUBLIC LIBRARY AND READING ROOM SHALL BE ESTA- BLISHED IN THE CITY OF DELRAY BEACH,FLORIDA. The motion for adoption was seconded by Mr. Miller and carried unanimously. ~i Mr. Hill reported that Mr. Boykin, recent purchaser of property in the S~ of Block 128, desired the City to clear a right-of-wwy on Seventh Avenue to permit ingress to his lot. It was recommended that the City do nothing in the matter until right-of-way deed is in the hands of the City Clerk. It was reported, also, that streets in Delray Beach Esplanade Subdivision were becoming pitted and worn because of the removal of sand from the new paving before same had become sufficiently donditioned. Mr. Cromer was instructed to notify the subdividers that said streets must be resanded and remain so until they are properly cured'1, As there was no further business to come before the meeting, Council adjourned to meet Wednesday, May 4th, at which time theorefunding program, recently submitted by the Bondholders' ommittee, would be taken up, the Mayor announced. ~~ (LcJG~ City Clerk APPROVED: ~lM}yDk .
