October 4, 1938
The Council met, in special session, on call
of the Mayor, at 7:00 P.M. for further consideration
and final passage of' the liquor zoning ordinance.
The City Attorney and all members of the
Council were present.
ClEirman Hill stated that before passing the
ordinance on its final reading, Mr. Gene Zapf wished
audience with the Council. Mr. Zapf explained that
several months ago, when first considering the open-
ing of a bar in Delray, en uiry had been lll9.de at the
City full as to whether anything proli1IDited the grant-
ing of a liquor license for such business on Lot 24
Block 92. He lEd been informed that he could obtain
a license in said locs tion and on the strength of such
information had purchased the property and ordered a
50-foot bar and fixtures costing several. thouS3.nd dollars;
that no~ the passage of an ordinance restri.cting liquor
busiress to a zone within 173 feet north and south
of the center of Atlan tic Avenue would exclude his
property and thereby put him to tremendous expense
and inconvenience.

In discussing the situation with Mr. Zapf,
the members unanim~usly expressed regret that he had
proceeded so far with his plals for a bar in the re-
Quested location and said they believed the town had
all the business of that type that it could support.
It was "thought Mr. Zapf was due considerat ion under
the circumstances, however, and finally Mr. Hall moved
that ordinance No. 244 be amended to show the North
and South boundary line s of the zone lyin!3 be tween
West Fifth Avenue and the Flor ida Intra-Coastal Canal
to be 283 feet North and Soutl:1 rpspectively of
Atlantic Avenue, instead of 173 feet, as previously
outlines., and that the Atlantic livenue entrance re-
quirerrent be eliminated. Mr. Wodischek seconded Mr.
Hall's motion, which carried una nimously on roll oall.

It was regUlarly moved seconded and carried
that said ordinance, as amended, be placed on its
second reading.

Mr. Wodischek seconded the motion :for adoption and on
roll call the vote was as fbllows: Mr. Gwynn yes,
Mr. full yes, Mr. Hill yes, :Mr. Miller .yes and Mr.
Wod ischek yes. The motion carried and the ordinance
was adopted. :Mr. Zapf's aupllcation for license wf!.s
tabled for the 14 daws required investigation of Council.
There being no further business to come
before the members, Council regularly adjourned.
