62-80 ORDINANCE NO. 62-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY REPEALING SECTION 30-18(B)(4)(b) AND ENACTING NEW SECTION 30-18(B) (4) (b) TO PROVIDE FOR ALTERNATIVES TO THE PAVING OF OFF-STREET PARKING AREAS; PROVIDING SPECIFICA- TIONS FOR SUCH ALTERNATE PARKING AREA IMPROVEMENTS; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the currently effective Code of Ordinances, Sec. 30-18 (B)(4)(b) requires all parking areas to be paved; and, WHEREAS, it is the recommendation of the City Administration that it is not necessary to pave all parking areas, especially in light of recent environmental conditions, attempts to minimize drainage runoff and the new products available on the market; and, WHEREAS, it is in the best interest of the residents and citizens of the City of Delray Beach, Florida, to make such change, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 30-!S(~) (4)(b) of the Co~e cf Ordinances of the City of Delray Beach, Florida is hereby repealed an~ new Section 30-18(B)(4)(b) is hereby enacted t6 read as follows: (b) (1) All parking areas shall be improved with either a paved surface meeting the published City Engineer- ing Department Standards or use a hard surface material, brick or turf block on a base course laid in accordance with approved manufacturer's recommendations, or other types of surface mater- ial subject to the approval of the City Engineer. (2) ~ere parking areas are only to be used on a once-a-week basis, stabilized sod shall be accept- able for parking areas. (3) In paved parking lots, that portion of the parking space(s) extending beyond the car stop may be sodded. Section 2. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
