AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, REZONING AND PLACING LAND PRESENTLY ZONED
RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT, IN SAD
(SPECIAL ACTIVITIES) DISTRICT, BEING APPROXIMATELY 61.91
ACRES, LOCATED SOUTH OF LINTON BOULEVARD, BETWEEN LINDELL
BOULEVARD AND S.W. 4TH AVENUE BEING IN SECTION 29, TO~-
SHIP 46 SOUTH, RANGE 43 EAST, AND AMENDING "ZONING MAP OF
DELRAY BEACH, FLORIDA, 1977".
WHEREAS, the Planning and Zoning Board, at the meeting held on
October 20, 1980, unanimously recommended rezoning and placing land pre-
sently zoned RM-10 (Multiple Family Dwelling) District in SAD (Special
Activities) District; and,
~EREAS, the City Council at its regular meeting of October 28,
1980, considered the rezoning request and determined that such change
should be made,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the following described property in the City of
Delray Beach, Florida, is hereby rezoned and placed in the SAD (Special
Activities) District as defined in Chapter 30 of the Code of Ordinances of
the City of Delray Beach, Florida, to-wit:
All of Parcel 2, LINTON CENTER, According to the. Plat
thereof as recorded in Plat Book 39, Pages 8 and 9, of
the Public Records of Palm Beach County, Florida; To-
gether with that part of the proposed abandoned right-
of-way .for Egret Circle, Jaeger Drive, Quail Road, and
Parcel S-6, lying northerly of the proposed realignment
of Egret Circle.
Section 2. That conditional use and site plan approval for the
subject property above are hereby granted subject to the following ex-
pressed conditions:
(a) That only the following conditional uses are approved:
1. Tennis club with swimming pool, racquetball, exercise,
health or spa facilities, including clubhouse restaur-
ant and cocktail lounge, pro shop, classrooms for
tennis clinics, meeting rooms, recreational facilities
for children and adults, and related facilities.
2. A maximum of 610 residential dwelling units.
(b) This approval is subject to the following requirements:
1. The perimeter road around the project shall be con-
structed to meet city road standards, namely a 24' wide
road with 1%" asphaltic concrete surface and standard
base and subgrade. Swale sections will be required for
the drainage.
2. The median is to be removed from the R/W of Lindell
Boulevard. The guard house is to be 150' back from R/W
at Lindell Boulevard.
3. Based upon the traffic impact, the following off-site
traffic improvements shall be required:
(a) Right and left turning lane at Linton Boulevard
into S.W. 10th Avenue.
(b) A left-turn lane off of Lindell Boulevard into
Egret Circle.
(c) Right and left turn from Egret Circle into Lindell
Boulevard.
4. Egret Circle is to end at the most easterly driveway
connection into the development; it is not to be paved
into S.W. 4th Avenue at this time, however a stabilized
roadway section could be constructed for emergency
access for the Fire Department.
5. Relocate seven (7) parking places as designated by the
City Engineer.
6. A street lighting system meeting city's standards will
be required for this project, and lights shall be in-
cluded along Egret Circle.
7. This approval is subject to the property described in
Section 1 being replatted pursuant to the City's Sub-
division ordinance (Chapter 24) consistent with the
terms and conditions of this ordinance. The traffic
and roadway related improvements specified in (b) 1
through 7 above, shall be included as part of the
improvements for which a surety deposit is required
under the Subdivision ordinance2
(c) That the development of this property is to be in accordance
with the approved site and development plan prepared by
Walter Taft Bradshaw and Associates, P.A., 4347 Seagrape
Drive, Lauderdale-by-the-Sea, as revised and dated September
12, 1980, which is incorporated by reference, except as
modified herein and made a part hereof and upon which the
City has relied in granting this approval.
(d) This approval is subject to t~e requirement that all irri-
gation for this project shall be from a source Other than
City water.
(e) The time limitation for this approval pursuant to Sections
30-21(E) and 30-22(E) shall be 18 months from the effective
date of this ordinance.
Section 3. That the Planning Director of said City shall, upon
the effective date of this ordinance change the Zoning Map of Delray
Beach, Florida, to conform with the provisions of Section 1, hereof.
Section 4. That this ordinance shall become effective ten days
after passage on second and final reading.
