70-80 ORDINANCE NO. 70-80 ~q ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE CODE OF ORDINANCES ~F THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 30-1, "DEFINITIONS", TO ADD A DEFINITION OF BOAT SLIP; AND BY AMENDING SECTION 30-17(G) "SUPPLEMENTARY REGULATIONS" TO ADD A NEW SUBSECTION 12 PERMITTING BOAT SLIPS AS STRUCTURES ALLOWED IN SETBACKS PROVIDED THEY ARE NOT BUILT CLOSER THAN TEN (10) FEET FROM ANY ABUTTING PROPERTY LINE NOR OCCUPY MORE THAN TWENTY (20) PERCENT OF THE TOTAL LOT AREA; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. wHEREAS, the Planning and Zoning Board did, at their meeting of October 28, 1980, unanimously recommend to the City C'ouncil amending Chapter 30, "Zoning" of the Code of Ordinances of the City of Delray Beach to permit boat slips in setback areas under certain conditions; and, WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the residents and citizens of the City of Delray Beach, Florida, to make such amendment, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 30-1, "Definitions", of the Code of Ordinances of the City of Delray Beach, Florida, is. hereby amended to add a new definition to read as follows: Boat Slips. An excavated area within a platted lot, which lot must abut a canal, lake or other waterway, which excavated area may be used for the docking or mooring of boats. Section 2. That Section 30-17(G), "Supplementary Regulations", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to add a new subsection to read as follows:. (12) Boat Slips, whether attached or detached, which shall not be built closer than ten (10) feet from any abutting property line, and which shall not occupy more than twenty (20) percent of the total lot area. Section 3~. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
