AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DEL~AY
BEACH, FLORIDA, CHANGING THE CITY'S LAND USE DESIGNATION
IN THE COMPREHENSIVE PLAN FOR THE SUBJECT PROPERTY FROM
MF-6 MULTIPLE FAMILY (6 UNITS/ACRE) TO MF-10 MULTIPLE
FAMILY (10 UNITS/ACRE) AND REZONING THE PROPERTY FROM
PRD-7 (PLANNED RESIDENTIAL) DISTRICT TO RM-10 (MULTIPLE
FAMILY DWELLING) DISTRICT. SAID PROPERTY BEING IN THE
WEST HALF (W½) OF THE NORTHWEST QUARTER (NW%) OF SECTION
19, TOWNSHIP 46 SOUTH, RANGE 43 EAST, WHICH PROPERTY IS
MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE, AMENDING
THE LAND USE PLAN AND "ZONING MAP OF DELRAY BEACH,
FLORIDA, 1977".
WHEREAS, the Planning and Zoning Board, at the meeting held on
September 15, 1980, unanimously recommended that the City's Land Use
Plan designation in the Comprehensive Plan,. for the subject property be
changed from MF-6 Multiple Family (6 units/acre) to MF-10 Multiple Family
(10 units/acre) and that the property be rezoned from PRD-7 (Planned
Residential) District to RM-10 (Multiple Family Dwelling) District; and,
WHEREAS, the City Council at the October 14, 1980, regular
meeting considered the recommendation of the Planning and Zoning Board;
and,
WHEREAS, the City Council concurs in the recommendation,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the legal description of the subject property is
as follows:
The South 541.55 feet of the North 1055 feet of the South
2015 feet of the W ½ of the Northwest ~ of Section 19,
Township 46 South, Range 43 East, less the West 100 feet
thereof and less the following described parcel:
Commencing at the Northwest corner of Section 19, Township
46 South, Range 43 East; thence on an assumed bearing of
South 00°06'54" West along the West line of Section 19-46-43
a distance of 1620.00 feet, thence North 89°30'23" East a
distance of 100.00 feet to the point of beginning, said
point being the Northwest corner of the Plat of Lago Del Rey
as recorded in Plat Book 30, page 69, Public Records of Palm
Beach County, Florida; thence from said point continue North
89°30'23" east along the north-line of said plat of Lago Del
Rey a distance of 1252.61 feet to the Northeast corner of
said plat of Lago Del Rey, thence south 00"01'15" East along
the East line of said plat of Lago Del Rey a distance of
84.95 feet, thence due west along a common line of Tract A
and Tract B of said plat of Lago Del Rey a distance of
1257.45 feet to the West line of said plat of Lago Del Rey;
thence along said West line North 00°06'54" West a distance
of 74.13 feet to the point of beginning.
Tract "B" as recorded in Plat Book 30, page 69, Palm Beach
County Public Records and other lands lying in the West Half
(W½) of the Northwest Quarter (NW%) of Section 19, Township
46 South, Range 43 East, Palm Beach County, Florida, being
more particularly described as follOws:
Beginning at the Southeast corner of Homewood Lakes Section
"A", as recorded in Plat Book 33, page 192, of the Palm Beach
County Public Records; thence West along the South line of
said Homewood Lakes Section "A" a distance of 1254.18 feet to
the point on the East right of way line of Lake Worth Drainage
District Canal E-3 %; thence along said right of way line,
parallel to and 100 feet East of the West line of said Section
19, South 00°06'54" East, a distance of 497.45 feet to the
Northwest corner of said Tract "A"; thence East along a line
parallel to the North line of said Phase II B, a distance of
1253.36 feet to a point in the West right of way line of
Homewood Boulevard, said right of way being also the East
line of the West Half (W½) of the Northwest Quarter (NW%) of
the aforesaid Section 19; thence North 00°0I'15" West along
said west right of way line of Homewood Boulevard a distance
of 497.45 feet to the point of beginning.
Section 2. That the Land Use Plan designation of the subject
property in the Comprehensive Plan adopted by Ordinance No. 65-79, is
hereby changed to MF-10 Multiple Family (10 units/acre).
Section 3. That the property is hereby rezoned and placed in
RM-10 (Multiple Family Dwelling) District, as defined in Chapter 30
"Zoning" of the Code of Ordinances of the City of Delray Beach.
Section 4. That the Planning Director of the City of Delray
Beach shall, .upon the effective date of this ordinance, chang~ the Land
Use Plan and Zoning Map of Delray Beach, Florida, to conform with the
provisions hereof.
Section 5. That this ordinance shall become effective ten days
after passage on second and final reading.
