AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, BY AMENDING
'SECTION 30-1 "DEFINITIONS" BY ADDING THE DEFINITION OF A
SCREEN ENCLOSURE; AMENDING SECTION 30-8.1(R) PRD-4 (PLAN-
NED RESIDENTIAL DISTRICT), SECTION 30-8.2(R) PRD-7 (PLAN-
NED RESIDENTIAL DISTRICT, AND SECTION 30-8.3(R) PRD-10
(PLANNED RESIDENTIAL DISTRICT) BY ADDING A SUBSECTION
(11) RELATIVE TO ALLOWING SCREENED ENCLOSURES IN SETBACK
AREAS IN THE PRD (PLANNED RESIDENTIAL DISTRICTS); PRO-
VIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Board at the November 17, 1980,
meeting unanimously recommended that Section 30-1, Section 30-8.1(R),
Section 30-8.2(R) and Section 30-8.3(R) relative to allowing screened en-
closures in setback areas in the PRD (Planned Residential Districts); and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
deems it to be in the best interests of the residents and citizens of the
City of Delray Beach to make such amendment,
NOW,. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 30-1 "Definitions" Of the Code of Ordi-
nances of the City of Delray beach, Florida, is hereby amended to add the
following: -.
Screened Enclosure. A framed structure completely
covered with open mesh screening only. Such enclosure
shall not have any type of opaque or transparent roof
or sides such as glass or similar materials.
Section 2. That Section 30-8.1(R) PRD-4, Section 30-8.2(R)
PRD-7, and Section 30-8.3(R) PRD-10 (Planned Residential Districts) of the
Code of Ordinances of the City of Delray Beach, Florida, ar~ hereby
amended to add the following subsection:
(11) Screened Enclosures
In zero lot line developments only, screened enclosures
may extend into the side setback areas, but shall not
extend closer than five (5) feet from the property
line, or exceed thirty-five (35) percent of the net
living area, exclusive of garages, balconies, decks,
porches, and common areas such as corridors.
Section 3. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 4. That this ordinance shall become effective ten days
after passage on second and final reading.
