85-80 ORDINANCE NO. 85-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA AMENDING CHAPTER 29 "WATER AND SEWERS" BY AMENDING SUBPARAGRAPHS (a), (b) AND (d) OF SECTION 29-63 TO CHANGE THE METHOD OF CHARGING MONTHLY SEWER RATES FROM A FIXTURE COUNT FORMULA TO NINETY-NINE CENTS ($0.99) PER THOUSAND GALLONS OF SEWERAGE FLOW BASED UPON 100% OF WATER USAGE UNLESS A METER IS INSTALLED AT NO COST TO THE CITY TO ESTAB- LISH ACTUAL SEWERAGE FLOW, PROVIDING MINIMUM MONTHLY CHARGES FOR RESIDENTIAL AND NONRESIDENTIAL USERS AND A MAXIMUM MONTHLY RATE FOR RESIDENTIAL USERS; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFEC- TIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section I. That Chapter 29 "Water and Sewers" is hereby amended by amending subparagraphs (a), (b) and (d) of Section 29-63 thereof to read as follows: (a) Residential dwelling units. A residential dwelling unit is herein defined to be any family Ii,ring unit, and, where two (2) or more families are living on the same premises, each shall be considered as a separate residential dwelling unit. In apartment buildings, condominiums;, coopera- tives, duplexes and the like, each living unit shall be considered a separate residential dwelling unit. A monthly sanitary sewerage service charge is hereby imposed upon each residential dwelling unit, as more specifically set forth'hereinafter, to which sanitary sewerage service is available through the facilities afforded by the municipally owned sewerage system, according to the following schedule: The charge for a residential dwelling unit shall be ninety-nine cents ($0.99) per thousand .~allons of sewerage flow per month~ except that there shall be the followin~ minimum and maximum charges: 1. Minimum Charge - Five thousand (5~000) .~allons per month. 2. Maximum Charge- Eight thousand (8~000) gallons per month. (b) Commercial and nonresidential units. A monthly sanitary sewer service charge is hereby imposed upon each commercial and nonresidential unit to which sanitary sewerage service is available through the facilities afforded by the municipally owned sewerage system, according to the following schedule: The charge for a commercial or nonresidential unit shall be ninety- nine cents (50.99) per thousand ~allons of sewerage flow per month, except that there shall be a minimum charge per month of five thousand (5~000) gallons. (d~) Sewerage ilow determination. The number of gallons of monthly sewerage flow for residential, commercial'and nonresidential units shall be based upon and equal 100% the water usag. e for those units as indicated by a water meter~ unless a customer installs at no cost to the City a separate meter to measure the actual sewerage flow from the subject unit. A separate meter may be used to measure actual sewerage flow for the calculation of rates only when the location~ installation~ and tyoe of meter have been approved by the City Manager or his designee. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affec the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
