04-79 ORDINANCE NO. 4-79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 13 "ELECTRICITY" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY REPEALING SECTON 13-4(f)(2) RELATING TO FEES FOR THE ISSUANCE OF ELECTRICAL PERMITS; REPEALING SECTION 13-4(f)(3) RELATING TO FEES FOR POOL HOOKUP AND ENACTING A NEW SECTION 13-4(f)(2) AND (3); AMENDING SEC- tion 13-4(g) TO REFLECT THE OPERATION OF ALL ELECTRICAL APPARATUS WITHIN THE CITY SHALL CONFORbI TO THE RULES AND REGULATIONS OF THE NATIONAL ELECTRICAL CODE, 1978 EDI- TION; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 13-4(f)(2) and (3) is hereby repealed and new Section 13-4(f)(2) and (3) is hereby enacted to read as follows: (2) The minimum fee for issuance of an electrical permit shall be: Residential $5.00 Commercial 10.00 Temporary & Construction Service 10.00 Number Amperes Fee 1-99 ........................ $25.00 100-149 ........................ 40.00 150-199 ........................ 55.00 200-399 ........................ 85.00 400-599 ........................ 175.00 600-799 ........................ 250.00 800-999 ........................ 350.00 1000 ........................ 500.00 When amperes are increased, the fee for change of service shall be based upon the amount of additional amperes as shown on the above schedule. Where the amperes remain the same or are decreased, the fee for change of service shall be $25.00. Where outlets are added but no increase in amperes, the fee for. 1 to 5 outlets shall be $10.00, and the fee for each additional 5 outlets or fraction thereof shall be $2.50. The electric service shall be grounded at meter can with proper size wire in rigid metal conduit with approved hub at water pipe. Any water pipe at dead ends must have a hose bib. To secure an electrical permit for a State approved Modular Home, the fee for building the service shall be $25.00. (3) Pool Hookup. When a pool is added to an existing struc- ture as distinguished from being part of'a new structure, the permit fee is $10.00. A pool hookup may include one or more of the following: Pump; Grounding; Light; Light transformer; Time clock. If other equipment is being installed in connection with a pool hookup and this equipment generates amperes, then in addition to the ten dollar ($10.00) hookup fee provided in this paragraph, a permit fee will be charged based upon the number of amperes according to the fee schedule set forth above. Section 2. That Section 13-4(g) is hereby amended to read as follows: (g) Adoption of National Electrical Code. Except as in this chapter otherwise provided, all electrical construction and all material and appliances used in connection with electrical work and the operation of all electrical appa- ratus within the City shall conform to the rules and regulations of the National Electrical Code, ~§ 1978 edi- tion, as recommended and published by the National Fire Protection Association for the installation of wiring and electrical apparatus for electrical purposes, of which copies are on file in the office of the City Clerk, which rules and regulations are hereby adopted and approved and made a part of this chapter as fully as if set out in length herein; provided that the rules and regulations of the National Electrical Code are not in any respect in conflict with the provisions of this chapter, this Code, the laws of the state or subsequent ordinances and resolutions of the City. Section 3. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the p~rt declared to be invalid. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
