Res No. 43-19RESOLUTION NO. 43-19 A RESOLUTIO OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING THE CITY TO TRA SFER REAL PROPERTY IN PALM BEACH COUNTY, FLORIDA, AS DESCRIBED HEREIN, HEREBY INCORPORATI GAND ACCEPTING THE CONTRACT STATING THE TERMS AND CONDITIONS FOR THE SALE AND PURCHASE BETWEEN THE BUYER A D THE CITY OF DELRAY BEACH, FLORIDA; A D AUTHORIZI G THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO EFFECTUi\ TE SUCH SALE; PROVIDING i\N EFFECTIVE DATE AND FOR OTHER PURPOSES .. WHEREAS, it is in the best interest of the City of Delray Beach, Florida, to stimulate the growth of affordable housing within the City; and WHEREAS, the City of Delray Beach, Florida, entered into an Interlocal Agreement and Multiparty Agreement for the Eagle est Program Project #3 at Atlantic High School Career Academy ("Interlocal Agreement") between the City of Delray Beach, the Delray Beach Community Redevelopment Agency ("CRA"), and the School Board of Palm Beach County, to build a single-family residence on property located at 108 N\XI 12'h A venue in an effort to stimulate the growth of affordable housing; and WHEREAS, the Buyer hereinafter named desires to buy the property hereinafter described from the City of Delray Beach, Florida, in furtherance of the Interlocal Agreement; and WHEREAS, it is in the best interest of the City of Delray Beach, Florida, to transfer said property to be used for affordable housing purposes. OW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSIO OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the foregoing recitals are hereby incorporated by this reference. Section 2. That the City Commission of the City of Delray Beach, Florida, as Seller, hereby agrees to transfer to Delray Beach Community Land Trust, as Buyer, for the purchase price of Ten Dollars and 00/100 cents ($10.00), said property being described as follows: Commencing at the Southeast corner of the East half (1 /2) of the Southeast guarter (1 / 4) of Lot 2, Subdivision of Section 17, Township 46 South, Range 43, East, as recorded in Plat Book 1, Page 4, of the Public Records of Palm Beach County, Florida; thence run Northerly along the East line of Lot 2, a distance of 100.0 feet to a point; thence run Westerly along a line parallel with the South line of said Lot 2 a distance of 25.0 feet to the Point of Beginning; thence continue Westerly along the same course a distance of 99.55 feet to a point; thence run Northerly along a line parallel with the West line of said East half (1/2) of the Southeast guarter (1 / 4) of Lot 2, a distance of 75.3 feet to a point; thence run Easterly along a line parallel with the South line of said Lot 2, a distance of 99.41 feet to a point; thence run Southerly along a line parallel with and 25.0 feet \Xl est of the East line of said Lot 2 a distance of 7 5.0 feet to the Point of Beginning. That the terms and conditions contained in the As Is Contract for Sale and Purchase and addenda thereto between the City of Delray Beach, Florida, and the Buyer as hereinabove named are incorporated herein as Exhibit "A". Section 4. That the terms and conditions contained in the Deed between the City of Delray Beach, Florida, and Buyer are incorporated herein as Exhibit "B". Section 5. That the City Manager, acting on behalf of the City of Delray Beach, is hereby specifically authorized to negotiate, enter into, execute, and deliver such other documents relating to the sale of the subject Property as the City Manager deems necessary and appropriate to effectuate such conveyance. Section 6. This Resolution shall become effective immediately upon adoption. 2 RES. NO. 43-19
