36-79 VOID ORDINANCE NO. 36-79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 2 "ADMINISTRATION" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY ADDING SECTION 2-26, CREATING A DEPARTMENT OF PER- SONNEL, AND SETTING FORTH THE FUNCTIONS OF THAT DE- PARTMENT; AND CREATING THE POSITION OF DIRECTOR OF PERSONNEL AND PRESCRIBING THE DUTIES TO BE PERFORMED BY SAID DIRECTOR; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Personnel functions of the City of Delray Beach have increased to the point that a separate Department is needed; and, WHEREAS, to complement a Department of Personnel, the position of Director of Personnel should be created: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 2 of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended by adding Section 2-26 to read as follows: Section 2-26 Department of Personnel created and its functions; Office of Director of Personnel created and duties of office. (A) Department created; functions of Department. There shall be and there is hereby established in the City, a Department of Personnel. The functions of that Department are as follows: (1) Administration of the City health insurance program; (2) Processing and investigating unemployment compensation claims, and representing the City at hearings and on appeals of such claims; (3) Keeping and updating annually Equal Employment Opportunity Commission statistics and accounting systems; preparing annual E.E.O-4 report; and keeping Department heads apprised of Equal Employment Oppor- tunity Commission requirements and prohibitions; (4) Drafing policies for City Manager approval; and giving explanations and interpretations of policies to employees and department heads on a daily.basis; (5) Administering City's Workmen's Compensation and injury benefit programs including processing and investigation of claims; and monitoring rate of claims; (6) Attending labor relations negotiation sessions; performing research and gathering statistics; writing reports, briefs and corre- spondence; keeping notes on negotiating sessions and current status of negotiations; (7) Employment recruiting, screening, interviewing and testing of applicants, and certifying exhausted eligible lists, in order to maintain a flow of applicants into vacant City positions; (8) Applying for and administering federally funded personnel programs; (9) Classification, evaluation and reclassification of jobs; (10) Maintaining personnel files on all employees; (11) Performing such other duties as the City Manager from time to time shall require. (B) Director of Personnel office created; duties. There shall be and there is hereby established in the City, the Office of Director of Personnel. The City Manager shall appoint the Personnel Director who shall be responsible for the performance of the duties imposed on the Director by this Section 2-26, which shall include the supervision of and carrying out of the functions of the Department of Personnel as set out in Section 2-26 (A) above, as well as the per- formance of such other duties as the Ci. ty Manager, from time to time, shall require of the Director. Section 2. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be de- clared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
