39-79 ORDINANCE NO. 39-79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 26 OF 'THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, "VEHICLES FOR HIRE", BY REPEALING SECTIONS 26-1 "RATES CHARGED PASSENGERS--GENERALLY", 26-2 "SAME--MINIMUM CHARGES PERMITTED", AND 26-3 "SA2~E--POSTING", AND ENACTING NEW SECTIONS 26-1 "RATES CHARGED PASSENGERS" AND 26-2 "SAME- POSTING"; PROVIDING FOR THE SETTING OF CHARGES FOR TRANSPORTATION SERVICES BY THE INDIVIDUALS, FIRMS OR CORPORATIONS HOLDING THE CERTIFICATES OF PUBLIC CONVENIENCE A2~D NECESSITY; PROVIDING THAT THE SET SCHEDULES OF CHARGES SHALL BE CONSPICUOUSLY POSTED IN EVERY TAXICAB OR MOTOR VEHICLE FOR HIRE IN THE CITY; PROVIDING FOR THE RENUMBERING OF THE REMAINING SECTIONS TO CONFORM HEREWITH; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council has determined that it is in the best interests of the residents of the City of Delray Beach to remove the current restrictions on charges by taxicabs or other motor vehicles transporting passengers for compensation within the City in order for these charges to be determined by the market place, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Sections 26-1 "Rates charged passengers -- Generally'', 26-2 "Same -- minimum charges permitted", and 26-3 "Same-- posting" be, and the same are, hereby repealed. Section 2. That new Section 26-1 "Rates charged passengers" is hereby enacted to read as follows: Section 26-1. Rates charged passeq~ers. All charges for transportation services by taxicabs or other motor vehicles transporting passengers for compensation within the city shall be set by the individuals, firms, or corporations holding the !i certificates of public convenience and necessity. Section 3. That new Section 26-2 "Same -- Posting is hereby !!enacted to read as follows: Section 26-2. Same - Posting. !t A schedule of all charges for transportation services shall at all times be posted in a conspicuous position in every taxicab or other motor vehicle transporting passengers for compensation within the city. Section 4. That Section 26-4 and the following sections of i! Chapter 26 are hereby renumbered to conform herewith. Section 5. That all ordinances or parts of ordinances in i! conflict herewith be and the same are hereby repealed. Section 6. That should any section or provision of this ordinance ii or any portion thereof, any paragraph, sentence, or word be declared by a !, Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 7. That this ordinance shall become effective ten ~10) days after passage on second and final reading.
